Bullied
I lost my job June 2008, a month after I made my FIRST payment to GMAC. With the severance monies I received I continued to pay GMAC, but also contacted them the following week after I lost my job. They set up an arrangement with me in writing which expired in October 2008. In October I still had not found suitable employment so I contacted GMAC again. They stated they could not do anything as I was not LATE on my payments. However I was granted a 30 day extension that would carry me to December 6, 2008. Again I contacted GMAC to notify them that I had not found suitable employment. Again they stated that if I continue to pay what they tell me to pay and pay ONTIME, there should be no problem. I talked to two gentlemen between December 2008 and January 2009. On February 17, 2009, I was offered a permanent full-time job with a title agency about 27 miles from my residence. I was estatic! Two days later, GMAC Repossessed my car! I understand that I didn't have a job but I continued to show "good faith" by paying partial payments to them ONTIME as they stated to me over the phone. Not only did I lose my car, but I lost a good job as this job offer was over $10 per hour! I spoke with a person that was handling my account over at GMAC. She stated she had not heard from me in 60 days so she had the car repossessed. I was told over the phone that it would cost me over $1, 500 to get my vehicle back. I have no other choice but to lose a job and a car in one month. This could have been handled so much better. The story is worse because I left out many details, but this is what happened in a nutshell.

Awful company
Local resident has tried unsuccessful to work with GMAC on a leased vehicle by either extending the lease or refinancing to lower payments due to being unemployed for one year and has been told after numerous phone calls that there is nothing they can do for this person. Email was sent to Vice President with reply to contact Customer Service...they cannot do anything.

One phone call stated that they would speak to a supervisor who would contact me within 72 hours. After three phone calls to see why person hadn't been contacted was told that they would put it on priority and someone would definitely contact this person. Nothing to date.

Time frame: 7 months.

Called dealer who could not do anything for me on a leased vehicle due to the fact that they are not allowed.
Have disability insurance on vehicle but it does not cover Unemployment. Every attempt has been made to resolve this matter to no avail. Person is not looking for a "free" pass just some assistance in lowering monthly payments! Most finance companies are now offering relief to millions who are unemployed due to the state of the economy. Why not GMAC? It is a sad state when you are trying to work with a company to pay and they are not willing to work with you...

No where to turn...no relief for Unemployed!! Deplorable!!

Terrible company
On April 15, 2008 at around 1:00 AM, the crew of Rebello’s Recovery (who was hired by GMAC) came to our apartment to reposes our SUV due to late payment.

The SUV was parked in our gated apartment with the garage door secured. The said crew climbed the 7-foot garage and took the garage remote control from the SUV and towed the SUV.

The incident was witnessed by our neighbor, who happens to be my younger brother. According to my brother, when the SUV was taken out of the garage, the vehicle’s hood was damaged when the garage gate automatically closed while the SUV was being transported out of the apartment. Upon getting out, the crew lifted the rear door of the vehicle which resulted in hitting the metal bar of the garage gate – this had caused damaged on the rear light of the SUV. In addition, as the crew was towing the vehicle, it hit the side of the apartment garage which resulted in damaging the mirror by the driver side.

On April 18, the payment was settled with GMAC. I called Rebello’s Recovery to inform them about the release form and was advised to pick up the SUV on April 21. Rebello also send us a letter with all the allegedly properties that were in the SUV and the alleged vehicle damages when it was taken from my apartment. The company claimed that all the damages listed on the letter existed prior to April 15, and that the damages were not caused by their crew. This vehicle was bought brand new six months ago and there is no way that the damages that they alleges existed prior to towing it few days ago.

When I arrived Monday at Rebello, I was asked to sign a form that releases them from being liable on any missing properties and damages of the vehicle. I asked them that I need to see the vehicle before I sign the form. They denied my request to see the vehicle as it is allegedly against their policy.

The company called GMAC to convince us to take the vehicle out of their garage. I spoke with Leanne from GMAC and was advised to sign the form, which I denied.

I filed a claim from our car insurance, Geico, for the damages caused by Rebello. They are now claiming that the vehicle was towed outside the garage, which is totally a fabrication of what actually transpired on April 15. Geico was also denied to see the vehicle.

GMAC had agreed to pay for the damages but had advised us that they will demand that GEICO reimburse them for the costs of the repair. Per our insurance policy, the cost will be pass unto as, which is $1000.00 deductible. If we agree with this settlement, it is a obvious admission that the damages were not incurred by Rebello. I refuse to agree with this settlement.

As of this time, the vehicle is still under the possession of Rebellos, due to the fact that I refused to sign the release of liability form.

I really didn’t expect that I would be so late for my payment, because it is supposed to be automatically deducted from my bank account I enrolled sometime of March, and I just received there termination letter of my Direct pay on April 29, 2008. I don’t really mind about the payment but for the damages that they did to my truck. It’s like purchasing something that I didn’t even seeing it. We need help, we’re looking up for a lawyer that could help us, but they said that this case is too small to be handle. They asking us about how much could be the damages worth, but we don’t know because that company doesn’t want us to see the vehicle.

Terrible experience
When we bought our Monte Carlo from GM we were given a price of 27500. Now that GMAC is going under, they told us that we were originally told we could buy out the car at the end of our lease for around 8000, but now we have to buy it out for 13500! The guy on the phone just kept saying, "That's not how we do Smart Buy anymore", when I said that so now you want us to pay 37000 not including interest for a 30000 vehicle, the guy just said sorry maam that's how the Smart Buy works now, but he can't find our contract to send us. Then he hung up on us! We will NEVER buy another GM vehicle again! These people tell you what you want to hear to buy the product and then change it later and say they will "reprimand" the person who told you wrong.

LOAN MODIFICATION
On July 2008, We requested to GMAC the Loan modification for our current occupy property ( Bighorn). As per the Lender GMAC there was an agreement for borrowers to pay a monthly mortgage $2, 400.00. Which Borrowers agreed to purse the Loan Modification and to pay this amount. They were about to send such payments. We called GMAC and every time some else was answering and we were receiving from GMAC different response. On December 222, 2008 the attorney sent a letter rquesting of expnation of why a default notice was sent to the client when we were still in process of 3 months trial loan modification. GMAC never answered this letters from the attorney instead they porceeded suddently in taking the pricipal primary home foreclosed/took away in now we are with 3 kids in the street. GMAC tood my other two investment properties are on a trustee sale.
What a surprise that after being notified by the Law Office of Cesar Fumar that the payments will be $2, 400.00 per month ( Period of trail told by GMAC). We were then informed that the loan Modification was stopped.
Suddenly, on May 19, 2009 the Bighorn property was sold by trustee sale by GMAC.
Now we have the other two properties on trustee sale.

The hardship are:
• We have 3 kids, 17 years old, girl 13 years, girl and 11 years old boy. We are afraid where are going to go with the 3 kids.
• I have a husband ill and he is on permanent disability.
• We were both working before, however when my husband became ill, now, I am the only one with a salary.
• 2006 we moved to our dream house on 4512 Bighorn Ct. Antioch. Putting $140K as dowmpayment. We do not understand how GMAC accepted the application for this loan which we were not aware of the kind of loan GMAC was offering. We were not explain about this type of loan were on this GMAC market and we were not explain about the drastically change coming on July 2008 instead of November 2008.
• We were not aware what of kind of loan or income it was submitted to GMAC to make us to qualify. when the changes arrived on sometime last year 07-2008. We were not aware on time about this either.
• We were paying the mortgage on time $1, 725.00.
• On November 2008 there was a change coming to change drastically the loan amount to $4, 232.37.
• We thought we had enough time to apply for this loan Modification and not to loose our dream house for our kids to live. WE WERE NOT AWARE OF THE OVERCOME FOR YOU ( GMAC) TO drastically TO CHANGE the amount of $1, 725.00 to $4, 232.37 at once on the same month of July 2008 as you informed we owe you from July 2008 when the change was suppose to start as November 2008 the amount of $4, 232.37. Since, you informed us that we owe you this amount starting July 2008 of course we were coming delinquent/ default starting July 2008.
• We did not receive any responses to our letters sent to you from the Law office WE wanted an explanation why that change took place on July 2008 and not on the date that it was supposed to be which it on November 2008.
• This is that hardship that lead to be on default and this hardship made to lead to loose our dream house “Bighorn.” The house was on trustee sale and no body from your GMAC seams care about. Where is Obama Plan to rescue our dream house. Where is the program affordable plan from Obama. Where we can find any body to helps us. I have a husband who is permanent disable. Why in the first place you people accepted the application loan and accepted my down payment of $140, 000.00 and now we are on the street with 3 kids. Is any body there - a Lawyer who can fight for us. we want this loan to go in investigation. We want Obama to hear our hurt finances from this giant loan departments. Called customer services and one person answers and next day is other person and so on.

GMAC took my dream house unfaily. We were doing our payments on time.
When we requested the loan modification and we wanted to continue in making the payments then we could not make the payments online.
GMAC started returning the payments back because they advanced to charge the monthly mortgage of $4, 232.37. as July 2008 when in the reallyty was suppost to strat that change on November 2008. This is why everything started. It make us to become in default on the payments. GMAC mortgage promised our loan modification during previous contacts earlier in 2008.
GMAC Mortgage is the worst company we've ever dealt with.

My husband is disabled and we have a daughter who is going to be hospitalized sometime next week.

Is any body there to help us. Please Obama help us. We want Univision to know this.

Is any body there with the same situation call us.

Very nasty and not helpful
Mrs. landers was very rude and nasty from the GMAC financial services. I understand I'm late, but she don't have to talk to me like that I 'm a human being and things happen. She stated that it was in the repo are and there was nothing I can do about it after today. I explianed to her that the only thing I can do was give the payment on Saturday, and she told me that they could not wait until Saturday. She was very nasty, and not helpful at all.

Lies, Fees, .........
I have been trying to work with GMAC since Dec of 08. I called them in Dec when I had missed my first payment to give them information on why I was late and was having a hard time. I was told to call the refi dept. In Jan. the Hope for Homeowners people sent in a modification request that was denied by GMAC because they said I had too little income. Funny though that a month later (when I was 3 months behind on my mortgage) I qualified for a modification. I have asked for a Home affordable Modification (obama plan) and have received nothing from them but the run around. I cant get any answers on the phone other than more questions. They have charged me $1400. in "fees" that they say are associated with my modification, but I dont have one yet and they refuse to send me any paperwork telling me what those fees are. The payment they have me at now are only $200 less than my original $3100 a month payment. If this is my modification, what a joke. This IS NOT what the Home Affordable Mod is suppose to be AND the fact that our government is pouring MILLIONS into this company while they screw the americans doing business with them is what makes me the most angry. Where is the accountability? Is the government even asking them if they are helping people before handing over our TAXDOLLARS?

release of lien
My son leased two vehicles from GMAC last year and they accidentally put me as a co signor on both of these vehicles and not even using my right birth date. They used my wife, s birth date. They aknowledged there mistake and told me it would be fixed in 30 days. A year later I found out they are still on my credit report. The letter dated May 1/2008 will be forwarded to my lawyer asap. Mortgage
On 04/01/09, just before a Sheriff's sale was scheduled for my primary residence, I received the following letter from GMAC:

Dear James
As we have been informed the above-referenced property is vacant, we will be sending a representative to the property within seven days to rekey and winterize, if applicable.

We are taking this action for the protection of our security under the terms of the Mortgage/Deed of Trust.

If you are maintaining the property, please contact teh Collections Department at 888-714-4622 and we will attempt to cancel the work order.

Collections Department-Loan Servicing

Since I LIVE HERE, I called to "cancel the work order, " which the representative did right away and seemed eager to dismiss the issue and get off of the telephone. I told her, "You know, I find it hard to believe that with SO MANY forclosures out there, that GMAC is sending people around to each of them to get "informed" about whether the property is vacant, and to rekey the property. This seems like more of an effort to avoid waiting the 6 months after forclosure to kick people out by having GMAC say the property wasn't occupied . . ."

She said that, "Yes, we send those letters out to everyone, and if they call in, we note that the property is occupied."

What a LOAD OF CRAP! So GMAC is putting hundreds of thousands of homeowners in a panic, as if they had nothing else to have anxiety about, by stressing them as to whether they have 7 days rather than 6 months to get out of their house after forclosure. And they do this because GMAC is too lazy, cheap, and greedy (sound like a familiar pattern? Like the one that got us into this mess?) to actually let the presumption be that the home is occupied, or to go check it out for themselves. There was NO INFORMATION that would have suggested I was NOT LIVING HERE. GMAC was on a fishing expedition and was hoping to bypass the President's efforts and statutory timeframes by claiming they'd made an effort and found the home unoccupied due to a lack of a response. If that's not illegal, it should be. I recorded the conversation.

closing fee
I had a Chevy Colorado on a SmartBuy. I still owed on the vehicle, but I traded it in for an Impala in November of 2007. My dealer and I had to get GMAC on the phone to get a payout. During the course of the conversation, GMAC stated that I would receive a refund. I thought, "Wow, great." Well, a month passed by and I called GMAC. They said the truck was still on the lot, and nothing could occur until they sold it on auction. Needless to say, the truck did not get put on auction and then sold until February of 2008. They finally sent me a refund for $600. Two months later, I get a letter from GMAC saying I owe $250 for a closing fee. I called them up asking why I would owe a $250 closing fee when they sent me a refund for $600. Why would they not take the $250 out of the $600. The representative told me not to worry about it and they will waive the fee. Granted this is either March or April of 2008. Fast forward to April 10, 2009. I received a letter from them stating that if I pay $200 within the next ten days, the debt will be closed. So I called them up again. It turns out that the waiver was denied, no one notified me of this. They stated that they did attempt to contact me. I called numberous times complaining about this. The first two reps stated that there was no phone number on file. The third stated that there was a number on file and that they did attempt to reach me. When I asked to talk to a supervisor, three different times of the day they stated that the supervisor did not start for another thirty minutes. When I finally talked to a supervisor, she stated that someone contacted me in August of 2008. I have no record of this call. When I asked for a transcript of attempts to contact me, they refused to give me a copy. I've had the same phone number and address all during this, so I know they are lying. My current car was also financed through GMAC, so any mail from them I paid particular attention to. They are saying they attempted to contact me, which they did not. They won't even give me evidence to prove it. I told them to check my payment history, I've never missed nor have I ever been late. I told them to check my credit score and they would see that I take these things seriously. It's not about the money, $250 is not a big deal. This is all about principal. They lied about attempting to contact me. They sat on this for almost a year, and they expect me to pay within ten days or they will send it in and affect my credit. I told them I will send what I can afford when I can afford it. I've decided to send them $25 a month, so I can satisfy this situation eventually. I will not ever in a million years use GMAC again, and as long as I have air in my lungs I will tell everyone I come into contact with. I did file complaints with the Better Business Bureau and also the Federal Trade Commision. If anyone knows of anywhere else I can complain please let me know. IT WOULD ABSOLUTELY POSITIVELY BE MY PLEASURE TO.
