This correspondence is requesting Sears to provide a refund in the amount of $ 3, 382.00 paid on July 9, 2009 for Home Improvement Services not received.
The sequence of events is as follows:
While shopping in the Sears store located on Roosevelt Blvd., Phila., PA, I was solicited by Sears for a free home estimate for Home Improvement Products. An appointment was scheduled, and two representatives (Jeff Rosen & Nichole- Chicago office) reviewed the work needed and proposed kitchen remodeling as per above Attachment 1). I was advised at that time by the representatives that the price quoted was only FIRM if I contracted that day, even though full financing was not obtained. The total contract cost was $11, 272.00 on which a 30% Initial payment was paid in the amount of $3, 382.00 via a personal check # 214. This was cashed by Sears on July 17, 2009. This job was cancelled on July 12 when the Owner identified a major defect in the walls on which kitchen cabinets (Inspection Report available) were to be installed, as well as rejection of financing by Sears financial sources.
In the intervening six months I have made the following attempts with Sears to:
1) Have the $3, 382.00 applied for store credit (not allowed by Sears policy)
2) Have Heating Boiler Installation (see Attachment 2)
3) Have a Steel Rear Door Installation (see Attachment 3) This quote was very uncompetitive and was cancelled via Attachment 4).
These attempts to utilize monies paid to Sears a half-a-year-ago have been unsuccessful. I believe I have acted in good faith in these matters and I have no conflict with those Sears representatives I have dealt with. This issue could have been avoided if financing had been obtained prior to the Initial payment. This Owner’s mistake was in being pressured to hold the price FIRM.
Therefore, I request a refund in the full amount ($3, 382.00), remitted to the undersigned, at the address indicated. I also request a response within 15 business days from receipt of this correspondence.
I am on a fixed income(Disability) and the amount in question is essential to me.
P.S. Sears’s standard form NOTICE OF CANCELLATION (S8-Rev.07/08) contains inaccuracy as follows: 1) No telegram service is available at the location stated. 2) Appropriate Fax or telephone numbers are NOT provided nor are readily available for this location. This makes it difficult to comply with the cancellation provision in a timely fashion.
