Unable to negotiate
10+ years as a customer until 2004 when I began to have problems (I lost my job). They were nice to help (help??? you don't have a job and what do they do: don't stop the late fees, don't stop the monthly inspections fee, and others... on top, they add the catch up payments, so you ending paying about 50% extra a month... remember, no job).

Then, I when back to full time at the end of 2006, but I was behind payments so now, no more negotiations, even though I have a good salary and I am willing to abide to their requirements. The problem is that they refuse to negotiate. In the meantime, they tell you that they are "checking" the requirements when in reality they were planning the foreclosure. As a result, I have a foreclosure date of December 4, 2007 given to the North Texas Housing Coalition on November 9 (Christmas present!).

I don't understand why they don't want to negotiate (well, kind of, the balance of the house is $90K, the market value is $150K, 11 years at 10% ARM, they already got the money for this house, so they don't care about foreclosure, makes sense). Yes, my credit report shows $0 balance and probably it will screw up my credit as soon as they insert the "foreclosure" on it.

I wish they could be more open to talk, at least now that I have a full time. They could answer the calls and tell you and don't play the game that they are "checking" when in reality they are proceeding with the foreclosure. Bad deal GMAC/Homecomings Financial. Not for Texans. No more.

Unlawful mortgage actions

In the month of june 2007, i request a re-finance payoff with a sema (transfer of re taxes) which would have saved me thousands of dollars n my closing n monthly payment would have been less, homecomings financial (gmac group) gave the payoff figure by did not produce the re taxes transfer. My broker called, my attorney, the new bank called for a period of three months 3-4x a week with no results.than they notified me there will be a fee of $600.00, i sent it to them still no transfer. This went on for 4 months until the re-finance bank said lets go without it. They re-ran my credit n homecomings had made my account delinquent for those 3-4 months. It was never delinquent prior to this transaction. When i spoke with them about the fee i asked should i still make my monthly payments, they told me no, because i'm refinancing. Well on my credit report shows payment 3 months delinquent and they will no change it after i found this out i immediately paid them by it's still on my credit report n now i cannot refin to get away from them. Also around this same time they sent me foreclosure documents which i took to my attorney he said these people are unbelievable and should be held accountable. Once i cancelled the sema transaction n asked for my $600.00 to be returned to me i received a check in i yes i week,i copied it for proof n have a written request of the letter as proof. I also sent them a letter stating that i feel this account was intentionally sabotaged. Please someone sue these people n hold them accountable 4 there unlawful actions. How many others are out there that cannot pay like this and don't know what to do. The banking comm n the housing govt should be notified asap...

Stealing our home
We just received notice of foreclosure less than 1 month from now. Couple months ago we were pre approved by another company to refinance until they came back with payoff figure that included $9000 in prepayment penalties. We have had our home for sale for almost 1 year. Not even 1 looker, so what are they going to do with our house. They do not want to even try and work with us unless with have thousands of dollars. I told them if I had that kind of money we would not be late on our payments in the first place. Is there anyone who can tell me how I keep them from kicking us out of our home until we can figure this out? Has anyone filed lawsuit against them for predatory lending practices and won? We are at a loss and do not know what to do.

False Credit Reporting
Homecomings Financial's customer service does not serve the interest of the consumer. I fought serveral month to get from under a l6% interest rate and a $1900. I wrote GMAC Chief Executive Officer. He shifted me to an account executive. They did not hear anything I had to say. I was stuck with exorbant rates. My adjustable rate began to climb. My fixed retire income check was not enough to keep up. I fell behind, they began foreclosure procedures and placed foreclosure started on my credit file. I was able to bail out by finding a company who refinance my loan. My credit file reports a zero balance but the foreclosure started remains. I have requested that they remove the derrogatory item. They refuse. This type of credit history sinks my FICO score and prevents me from getting good credit rates. Homecomings is difficult and refused to assist the consumer. They know that the adjustable rate mortgages do not serve the long range interest of the consumer. Yet they persist in raking the consumer across the hot coals.

Faudulant Mortgage Practices
I am in Minnesota and am getting together a class action law suit anyone wanting to make these people pay for taking our homes due to there fraudulent mortgage practices send me your e-mail information and i will inform you of our lawsuit information.

Unethical, predatory lending and shady dealings

I have read reports and complaints all over the web.

I have filed reports with my states attorney general.

I have talked to several legal advisers.

Yet no one wants to put a stop to these crooks and their unethical, predatory lending and shady dealings.

I have been dealing with them for almost 6 years and have been foreclosed on twice... or they tried to foreclose.

The only way to stop them was to go into a chapter 13 while trying to resolve the problems.

I have sent them thousands of dollars besides my monthly payments.

They have ruined my credit so I cannot refinance and get away from them.

They add ridiculous charges to my account.

So I figured I would sell out... well I get a letter from them and they are asking for over $8,000.00 more for our payoff... well I am back to where I started 6 years ago and thousands of dollars ago.

Stay away from Homecomings Financial they are SHARKS out to rip you off and you will always lose, because everyones afraid of them!

I have 2 files of documentation on this company and proof of everything I am claiming.

Fraud, ripoff, predatory lending, cheating!
My husband and I have been fighting to keep our home since 2000, I have enough documentation to write a book on this company. We have been lied to cheated out of thousands of dollars and ended up in chapter 13 to keep our home. I have tried to find a lawyer to help in this matter but have not had any success in my area.
I have much to much information for me to post... but its all the same as I have read in other complaints on this site. I am at the end of my rope, we have been fighting so long... Beware!

Poor service!
After sending in payment, this company is holding the funds and not applying payments to our account. We cannot get anyone who can help us in resolving this matter. Very poor service!

Fraud and cheating!
This company has foreclose on my home after I set up payment plans to pay back payments during bankruptcy. Everytime we agree on a payment plan they never sent me a written document on where my monies was applied and how much i had to pay. Whenever I call I always talk to someone different and each time they have a different story. I know this company has fraudulently taken my home and I need someone to email me who has the same experience so we can have a lawyer look into this.

Rip off mortgage company!
This company bought our small second mortgage from our bank without notifying us, and canceled our automatic payment plan without informing us. Of course, not knowing they had our mortgage, we sent them no money as we did not even know they existed! They then reported us as delinquent! The ruined credit resulted in our being turned down for a college loan for our son, and required us to cash in an IRA to pay for that and pay subsequent penalties. Homecoming Financial then had the gall to ask us to pay them $123 in various fees they assessed because THEY canceled our automatic payment plan and did not tell us they held our mortgage! Their customer service, collections and loss mitigation departments were USELESS after HOURS on the phone. We are now preparing to sue them for ruining our credit and extorting extra payments without basis. If this ripoff company has bought your mortgage, I suggest you move heaven and earth to pay it off or switch it to someone else. They are a company from hell. It seems they want you to default so they can charge you fees and hopefully steal your house. The employees themselves are not to blame; they are just incompetent and have a management that is not interested in customers or them -- only in taking as much of your money as they can get away with.
