On the 18th of Aug, 2010, we signed a contract with Hong Kong Battery Co.(not a company, but a registered Hong Kong business, may be a sole trader) in order to purchase batteries. We transferred US$3973.10 as a deposit to its bank a/c from New Zealand. Shipment time should be med of Sept, according to the contract. However just after Harry (owner and operator of that business) had received the deposit, he changed shipment to med of Oct. I asked for a refund, but he refused. At that time he had already breached the contract. And since then, I found it's very hard to contact him: Harry didn't reply to my telephone calls and emails for most of time. Until the 15th of Oct, after several telephone calls and emails from me, he told me that shipment on time was still not a problem. It turned up a lie. Some days later Harry suddenly informed me part of products were ready, but insist that I must pay the balance first and pick up in Hong Kong. I didn't accept it at first because in the contract Harry must arrange shipment from H.K. to Auckland, New Zealand for us. To my surprise, finally after I found an agent in H.K. and I agreed to accept the conditions, he changed mind again on the third of Nov.: he promised to give our deposit back. However, we still haven't received any money from him up to date.
