My name is Ankur Mohan Agarwal, R/o C1/99, Main Market, Khajuri Khas, Delhi 110094.
I am using ICICI credit card number 4477 4645 6049 7004.
On 23rd June 201, I received a letter dated 16th June 2011 from ICICI bank stating that an amount of INR 4249.65/- is due on me and if the payment is not made within 7 days they will deduct the amount from my salary account which is also in ICICI bank with A/C no. 000701233926.
On 23rd night I spoke to ICICI customer care and was informed that the query relates to collection department which works between 8am to 8pm.
On 24th June 2011 an amount of INR 4243.65/- was deducted from my salary account.
I have not used the ICICI bank credit card since long. When I contacted on 25th June to the customer care, I was told that
"I made a payment of INR1300 on 24th May 2010 to Bharti Airtel through credit card, and made a payment to ICICI of INR1300 in July 2010 whereas an amount of INR1845.46/- was due on me at that time with late fee."
Thus the amount of INR 545.46/- which was a late fee was outstanding since July 2010 and subsequently it increased to INR 4249.65/- which they deducted on 24th June2011. In nut shell the total amount of INR4249.65/- is a penalty imposed by ICICI.
I told them that I never received a statement in June or July 2010 and it was me who after few days made the payment of INR1300 thinking that already many days has passed. After that also I never received any sort of correspondence from ICICI, not even my credit card statement.
But the customer care person told that my father received the statement of Sep2010. I don't understand what to do in this case. The customer care person even said that no complaint can bring my money back.
Also he told me that an amount of RS6/- (as amount due was 4249.65/- and amount deducted was 4243.65/-) is still outstanding on me and if I will not pay they will deduct with additional penalty from my account.
I would like to understand
1) If a bank can deduct money for its credit card on its own without being authorized by account holder?
2) If the whole action of ICICI is justified?
3) Is there any way I can get my money back?
