Worst mortgage bank ever
I have been trying to get a loan mod from Indymac/One West bank since October 2008, which has been almost a year now! They approved me, they disapproved me, they call me, I call them...nobody knows what the heck is going on! They lose my documents I send them, they mix up my files with other peoples and have the wrong information about me. It is such a frustrating and screwed up process. I seriously can't believe that this kind of situation can just keep happening, and not only to me but everyone of us poor souls that has Indymac as our mortgage lender! Something definitely needs to be done about them, they should not be allowed to be in business. I have done everything they have asked me to do and now I am completely fed up and want some action taken against Indymac! I would love us to all gettogether and form a class action suit against them.

Liars
OMG! We only had one more payment to make during our trial period and then I get this CERTIFIED lettter in the mail saying we are in serious default!! I call them up yesterday and they say "we were missing paystubs"!!! So we had to cancel it! BS!!! Because I called a week after we submitted the package and they confirmed they had EVERYTHING they needed!! They told me that I have to resubmit everything again for a new review. I was in tears yesterday...and they do not care!!! They are the biggest scammers out there. THEY LIE!!! SOMEONE from the federal government please step in and correct this.

Endless phone calls
They are the most unorganized bank in the USA. No wonder the government had to take them over. We have a small equity line of credit that has payments of approximately $150. per month. For the past 2 years we have always paid $500 per month in order to get the line paid off. Payment due date is the 26th and we have until the 9th. Indymac begins calling the house on the 27th at least 10 times per day. We not longer answer the phone when they call. How in the world do they get away with this stuff? Someone really needs to police them better. Best not to do business with them if you can avoid it.

They sold our home at auction without notifying us
We tried to modify for 7 months unsuccessfully so they filed a NOD and issued a sale date. A buyer presented an offer to purchase so the sale date was removed and the short sale was presented with a perfect A+ buyer. They took 3 months to review the offer & then they called the agent and said they were approving the short sale to hold tight and a counter offer was being over. In the mean time they sent the house to auction & took ownership of it, and just gave us 10 days to vacate. They are the scum of the earth.

Breach of contract
At the end of last Year I called Indymac for help. I could no longer afford my payments on my house. They told me to fill out the loan mod packet and send it with a payment of almost $3000. The deadline they gave me was 12/31/2008. I sent the loan mod packet with a payment on 12/27/08 and it was received in their office on 12/28/08. I even have the registered mail receipt and the person who signed for it in their office. On 12/28/08 they filed a NOD (Notice of Default). Since then I have been calling and following up with them and they are sending me in circles. They denied my loan mod, and won't give me a reason why. They also breached their contract with me, which was to send in a payment with the loan mod packet and everything would be OK. I am currently living in the house and don't know what to do. Indy Mac is full of fraud. Their promise to help consumers is fraudulent and deceiving. The lady I talked to on the phone today at Indy Mac was very rude. I told her I would go to my local congress rep with this breach of contract. Her response was "there are hundreds like you".

Banks Failure to Insure Funds
During a information phone call to Indymac, I was convinced by an Indymac customer service person to switch my Savings to a Premium Money market account and 4 month CD to obtain higher interest. My original account was covered up to $200, 000 with both daughters as beneficiaries of the trust.
The new account did not transfer this over the trust, nor did it ever receive a signature card for this account. In addition, the letter of notification for the 4 month CD maturity date arrived late. The bank essentially transferred my savings without insuring my money. The carelessness by the bank employee and the lack of oversight by both Indymac and the government entity responsible for oversight (OTS) have resulted in my sustaining a loss of more than $40, 000.
Is there anyone else who has had this experience? Are there any attorneys taking on a similar suit?

Uninsured FDIC savings
I was told that I was 100% insured. I had even changed my beneficiaries to make sure. Then they told me that I was not insured for some of the $$ because some of the beneficiaries did not qualify, even though Indymac assured me that all was in order.
Do we sue FDIC for lack of oversight? Do we sue the defunct bank?

uninsured deposits
WE ARE BEING ROBBED
I am also stuck for over $ 64, 000. in "uninsured" savings.
I have been e-mailing reporters,
senators, federal officials to no
avail.
I am collecting a group
of fellow "uninsured " depositors
to present a stronger voice in our
plea for our just due.
We have been swept under the rug!
The Treasury has a moral obligation to bail us out !!
They were not paying attention !!!
Instead they are rewarding the criminals.

Awful bank
I am one of the foreclosures with Indymac. My home is one that I live in, so I'm not a "house flipper". So, things are bad and I get in touch with Indymac's loss mitigation specialist. Basically, all he has to say is that I either have to come up with a lump sum to refinance or I have to furnish proof of more income! If I had money I wouldn't be losing my house!!!
To top it all off, the house is now not even worth $125, 000 (not selling at that price on the MLS over the past 8 months). This Indymac guy says if I refinance the house is worth $164, 000... I am wondering what planet he is on? Now, I've written Micheal Perry CEO for help, one week ago, and have heard NOTHING!!
Now, wonder why the banks continue to fail. If they operate like this one, their properties are just going to rot and lose value, instead of them getting something... they are choosing to get nothing...
