Unfair mortgage practices
I am currently in a a bankruptcy. My Mortgage is included in this Bankruptcy. My mortgage had been paid up as of April 2010 per Bankruptcy. The lender OneWest/IndyMac Mortgage claims that I am behind in the amount of $1044. I never received any documentation from the mortgage company or the bankruptcy regarding this until receiving a court order date. My insurance is included in the payments. My premium is 1263 a year. My principal and interest payment is $600 a month. My mortgage company wants me to pay 1073 a month until December of 2010. This includes 299 a month to go towards my insurance premium and $174.44 towards the amount I am behind. If I calculate correctly, it should only take 4 mos to pay the premium for the year. Why should pay over $1263. Starting January 2011 I am to resume to paying $899. My insurance premium runs from April to April renewal. Why should I have to pay any extra monies. This is truly unfair and I feel that this is Indymac Mortgage/OneWest way of trying to get my house. Please let me know what I can do to protect my interest in my home.
