James Mass sold me a tree in July 2008 which is defective - dead. I have telephoned his home numerous times but they rarely pickup the phone.
On one day I informed his wife of the reason for my call, the dead tree and warranty replacement, and she indicated her husband would be home in the evening to take my call. No one responded to several attempts.
The following day I called asked his wife to have Jim Mass call me back. However, that did not happen.
The following day I finally got a voice mail answering machine and left a message about the warranty issue. However my call was not returned.
Finally, I sent a letter via certified mail indicating Mr. Mass has been avoiding me but I want either the tree replaced, to be reimbursed for the price of $176.00, or permission to remove 2 trees from his lot as replacement. Mr. Mass never responded but I have the return receipt proving he received notice.
He has steadfastly avoids me and this tells me he will not honor his warranty as he spelled out in the document he provided when he sold me trees.
Jim Mass DOES NOT honor the warranty he writes and took the money and ran.
