I direct this letter to you as a matter of last resort. It is my hope that you will be able to assist us in this matter. I do understand that you might be receiving many of these complaints, but we are desperate. Allow me to retype the letter I wrote to the Estate Agency Affairs Board on the 7 February 2011 with not as much as an acknowledgement of receipt.
In November 2009 I attended an Auction for the property – Stand 104 Hurst Hill, Johannesburg also known as 15 Retief Street, Hursthill, Johannesburg. I immediately paid the Auctioneer R27 900.00 in cash. On the 30th of November 2009 they informed me that my offer has been beaten and that I should equal or better the new offer of R280 000.00. I subsequently decided to equal the new offer and deposited the additional R22 500.00 into their bank account – J&I Morton Estates and Auctioneers – Standard Bank, Gezina, Account No: 011795875, Branch Code: 014845. They emailed a receipt of payment and informed me that the lawyers would be instructed to initiate the transfer.
Since than I continually phoned them to determine the progress of the transaction. At first they gave me stories like the Sellers could not be located – Sellers Names: MM & CP Mbiza. These stories became less and less convincing until they eventually did not answer the phone anymore. I am extremely concern. I have deposited R50 400.00 into their account. They do not respond to my emails or answer the phone.
With the little money I had left I consulted a lawyer who proposed a letter of demand that was subsequently send to them. The lawyer, Strydom en Vennote, situated in Florida Roodepoort. This action, also, did not achieve the required result as they simply ignored the letter, I have no money to summons them as proposed by the lawyer at this juncture.
I do not want to embark on strategies that will require more money and I cannot afford to loose my hard earned money.
