La Jolla Residence Club is a total scam!
La Jolla Residence Club is a total scam! My husband and I purchased a timeshare from them on December 15, 2010. After going back home, we investigated the company online and realized what a rip off we had been part of. We emailed several times to inquire about our concerns and nobody replied. Therefore, while we were within our 5 day rescission period, we mailed a cancellation letter to them via FedEx. We again emailed them notifying them about our desire to cancel the agreement, but received no response. After a few days we received a letter signed by Francisco Kelly, the sales assistant, stating they have received our cancellation letter; but even though we did mail it within the allotted time we weren’t entitled to cancel our contract nor be refunded our $14, 800 American dollars, since the cancellation document would not have been delivered on or before December 22nd. We have been advised by the consumer protection agency and our attorney in Mazatlan that they are committing fraud, since law dictates that the cancellation notice should be sent within the 5 business days from the purchase, regardless of the reception date. In this case we have all documents that prove we were within the timeframe and La Jolla is just trying to keep our $14, 800 American dollars for nothing!
Be alert and don’t buy from them! They are not a trustworthy company, they are a total rip off! Stay away!

Phoenix and LaJolla Scam

Timeshare
My wife Pamela and I were on vacation 9/18/2010 to 9/25/2010 in Mazatlan, Mexico staying a t one of the timeshare resorts that we have owned for almost 5 years. The timeshare company we own is called El Cid Resorts and has multiple locations in Mazatlan, Cancun, and Cozumel, Mexico and we have 500, 000 points. We went to a timeshare presentation at a neighboring resort just up the beach from the Marina El Cid resort we were staying at only because they offered us $400 to attend. This company is called Residence Club La Jolla in Nuevo Mazatlan, Mexico.
During the presentation at this small resort La Jolla offered us much more than what was available at our current timeshare El Cid, for much less money. They also told us they were looking for people that owned el Cid points of 500, 000 or more and they were willing to make us a deal. La Jolla told my wife and I that they would buy our El Cid property from us for $104, 000 US dollars because they needed the space to bring people in from the US and Canada on free weekends to try and sell them a timeshare. Alfredo, the salesman, said they could average a 40% sales success from the people that they would bring in from the US and then they had an agreement with El Cid that the points would be sold back to El Cid after a year or two at a reduced price. Alfredo used names of the managers at El Cid that we know and was very convincing. He had all the right answers to our questions. All we needed to do was to pay La Jolla $31, 450 for a 200, 000 point timeshare deal that would, from their description, give us more abilities and weeks than we had before with El Cid. This was done and split up on 3 credit cards. My wife and I entered into the purchase contingent upon the completed sale of our El Cid timeshare. Alfredo told us that the development company, Phoenix vacation property, was buying our El Cid property. We then received a signed letter from Phoenix V.P.M that guaranteed the company would accept our El Cid timeshare and pay us $104, 500 within 90 days. We went ahead with the purchase.
On 10/16/2010 I received a call from Phoenix Vacation and they said they were a timeshare rental and sales company and they would be listing our El Cid timeshare on their website for sale. I have worked with timeshare rental and sale companies before and they have a poor track record of renting or selling anything. I have tried and call Phoenix and most times I get an answering machine. I Googled their address and seems to be phony; these people aren´t in Arizona. This is when I knew I had been scammed.
I checked the internet and found hundred of complaints against La Jolla and Phoenix Vacation management for doing the same thing to other people. I talked to Francisco Kelly the manager at La Jolla on 10/17/2010 and he said that we signed the paperwork and no refunds will be made.
The evidence is clear that La Jolla is nothing but a scam operation and is of no real value. I require a full refund for not receiving what was promised.
