First of all they verbally promoted their full refund guarantee on their "56 Days of Discovery" series self-development training. They did not provide the written guarantee any where on their websites. I had will received a written copy after I paid for the program and received the package a few days later.
It is a very stringent guarantee/refund plan. It states in writing that if dissatisfied I am eligible for full refund but "subject to 10% restocking fee". This restocking fee was not mentioned in there sales conversation or on there regularly scheduled webinars.
Their guarantee states their customers must perform studies in all earnestness yet they have rules that are unreasonable enough to deter earnest performance.
For instance, what I have experienced with the Discovery lessons online were glitches that caused my daily completion results to appear delayed. Also their online time monitoring system seems to have omissions and/or inaccuracies that misrepresents online interaction time. I have tried to contact them through chat or email about this.
First example: "4. It is mandatory that you do all 56 days of the program in earnest"
They claim that I have completed 17 lessons in 8 minutes or less as they state in their letter. I assume they claim in was not earnest. Virtually all of their lessons start off with the instruction to listen to a CD. So a number of times I had logged off within 8 minutes or less and then listened to their CD's and then re-logged back online to complete each exercise in all due diligence. I have even multiple journal entries that can attest to that fact. The creation of content of these journal entries had averaged well over 10 minutes. Some over an hour.
Second example: "7. You may only complete one exercise per day."
I was unable to close the completion button on numerous attempts on my first day lesson of online 1/11/2010. But the completion button worked on the following day 1/12/2010. That made the first and second days lesson appear to be completed on that same day. In actuality they counted their computer error as if it were my error and used it as one of the reasons for the denial of my refund. This incident re-occurred on a few other occasions.
Conclusion:
It is very possible that there is a fault(s) in their automated data processing and it should be examined in detail. If this situation had been and still is appearing with enough regularity it be resolved on a class scale. Their business practices and/or computer programs may have an impropriety(s) and/or glitch(es), by oversight(negligence) or intent, to defraud or deceive in any way or manner that is unethical or illegal.
Additionally:
They state repeatedly in their webinars that "The Discovery Series cost is $1, 695 of which $1, 000 will be paid directly to you(me or the new recruit)" in such a manner that leaves out the steps of:
1. new recruit pays $1, 695 for the discovery series
2. new recruit must also pay monthly $119.00 and/or $49.00 to market their products
3. new recruit will be strongly encouraged to buy the $8, 995 product and $14, 995 of which $5, 000 and $9, 000 respectively will be paid directly to the new recruit.
In actuality the new recruit may pay up to $26, 000+ before he/she sees his/her first $1, 000 because they have to make at least one sale in order to see anything. Therefore if they make no sale they will not see $1, 000 $5, 000 nor $9, 000 even if they pay $26, 000+. This misleadingly sounded as if a profit will be realized at the period of initial investment.
