I have been litigating a case against this California attorney and am quite frankly appalled by his utter lack of professionalism. I had the opportunity to litigate against him when he accused my client of wrongdoing. His case was based on the declaration of a witness who was paid thousands of dollars in cash to testify (still unsure if Luis had anything to do with this as it was his client, Jeffrey A. Cancilla that tendered the cash in exchange for a favorably worded declaration). His client, Jeffrey A. Cancilla has already been suspended by the State Bar.
Then Luis Magdaleno notices my client’s deposition. He arrives an hour late complaining the traffic slowed him down (keep in mind this is Southern California, traffic is as sure as the sunrise). Then at the Case Management Conference, all parties have to wait an extra hour because Luis Magdaleno’s phone line in his building is incapable of transmitting a normal conversation.
To top it off, I personally mailed discovery to Luis Magdaleno back in November. Written discovery must be responded to within 30 days or the party responding loses their right to object. Lu’s first response to the discovery is several days late and 75% incomplete. To top it off, he includes objections and threatens to seek a protective order. Despite 32 years in practice (so he claims), he somehow missed out on the fact that he lost his right to seek a protective order by not responding in time. In fact, as I post this in January more than 2 months after mailing the discovery, he’s still missing half of his client’s responses.
Stay away from this attorney; you’re better off representing yourself. He’s sloppy and will surely ruin your case.
