I contacted a attorney today he told me that he bring our complaints to the firm and they will let us know if they would take our case.

CLASS ACTION SUIT
MGC FRAUD
Like everyone here the same is happening to us they never sent a us welcome package nor do they paid our insurance or taxes. Not only that we found that MGC went under and another bank took them over however the fishy thing about this is they are still using the same name MGC doing the same exact things as MGC. I live in CT and I have written a letter to Richard Blumthol are State Attorney General Office but I have also been looking for someone to take this case I have contact Mr Weidner in PA whom specializes in CLASS ACTION SUITS. Please people help me fight these people are frauding us escrowing money and then not paying it, fraud remod's, they are stealing etc. . We need everyone to be apart of this no matter where you live we need to start this asap. I have never listed my name and number like this before but you must understand how serious this THEY ARE TRYING TO TAKE OUR HOMES ARE YOU WITH ME? thanks

NO COMMUNICATION
ACCORDING TO MY RECORDS, MY LOAN IS ALMOST PAID OFF. AFTER NOT GETTING A STATEMENT FOR MAY, I SENT A PAYMENT ANYWAY. ON THE DAY MY PAYMENT WAS DUE, I RECEIVED A NEW STATEMENT-COMPLETE WITH A DIFFERENT ACCT NUMBER AND ADDRESS. SO I AM WONDERING WHERE MY PAYMENT WENT. I STILL HAVE NOT RECEIVED A STATEMENT FOR JUNE PAYMENT. THEIR WEBSITE IS USELESS. SINCE I LIVE ON GUAM IT'S DIFFICULT TO PHONE THEM WITH THE TIME DIFFERENCE. WHAT NOW?

Not paying property taxes
MGC Mortgage did not pay my property taxes that were due on November 15, 2009. I have contacted them 27 times and have been told the same thing every time: 1) Yes we know we are in violation the our contract with you. 2) Yes, we know that we will have to pay the taxes plus the interest. 3) Yes, we see that your account is marked "urgent pay". 4) No, we do not know why it has not been paid.
In January of this year, I received a letter from MGC Mortgage telling me that they have underestimated the property taxes that are due and they are requiring me to pay an additional $160.00 per month. In November the escrow balance on my statements went from over $2000 to a negative ($165.00). So, I assumed they had paid my property taxes. When I called my county tax department the latter part of November 2009 that is when I was told they did not pay my taxes, but they did request a copy of the tax statement in August, 2009.
They have also tried to charge me a monthly "late fee" because they did not process my payment on time. I sent them notification of a their signed receipt of my payment allowing them 7 days processing time, so they reversed the fees. On average it takes them upwards of 21 days to process my payment.
I found out two weeks ago that the Texas State Banking Commission has taken over regulation of this company. So I contacted them. I was told by them that they have "floods" of complaints coming in about MGC not paying taxes or not paying insurance as stated in mortgage contracts. I was then given the web address within the Texas Banking Commission to download paperwork to submit to them for review.
I have noticed that they are aquiring a large amount of mortgages from large banks like Bank of America. Are they using my missing property taxes to assume these loans?

Where do I start...too many to count
My first encounter with this company I was told that I had over payments to my account. I never received statements so I thought that I could skip a couple months then I was told that that was not true and I was behind several months so starting last July I doubled my payments and was told that in January I should be current. Well I was told again that I had to pay another 200.00 that would bring me current. I just receive a call saying that I owe a month????I have been requesting statements for a long time. Today they call me again on my job about the supposeable late payment. Something is not right with this company. I was told that if I recently transferred from another mortgage company that getting statements were a problem. They're telling me all kinds of things. I was told to put everything in writing and to fax them my issues (which I"ll do), but some how I believe that this will be done in vain. I'm very angry reading all these complaints because I believe there is alot of fraud going on here and it's just not me. I hope that the attorney general gets involved. That's my next step

Beware
They can't get anything right. You call them, you fax them, you pay your payments on time via the computer and they have no clue what is going on. They send you late payment notices when your money has already come out of your checking account. They can't understand that your mortgage is variable and the rate went down. It is a nightmare. We have a file pages and pages thick. We have a short time left and it is ***. Not fair. I sure hope that someone out there shuts them down and moves our mortgage to a real company.

BAD Banking Business
I was transferred June 1, 2008. We were mailed this information about being sold late and directed to mail our payments to the new mortgage company by the 1st of the month. Which we always paid our payment on th 15th so our payment had already gone out for that month. they gave us a late fee. We noted that this was going to be a problem I called them never got an answer for days I called. Finally I got an answer 3 weeks later and I explained the lady was nice said that would not be a problem. I asked about a statement, and when they would be sent out they said the do not sent out statements, I said excuse me. I have never heard of a Mortgage Co. Not sending statements. She said it was a priviligage to receive a statement. I was shocked. At that point I knew that something was really wrong. We decided to pay off this company as fast as we could. We owed $33, 000.00 and some change, we sent them $20, 000 in July in which they cashed my check. And i kept asking for a statement to see what was being posted and they would not send one. Then in Aug. I sent $5000.00 more they held that and did not post it to my account even though they cashed my check. And still no statement. All the while I am making double payments too. I am determined to pay this company off. All the while they are charging me late fees, saying I'm late. Not every time just when they feel like it. I always paid two weeks in advance, always paid extra, and I was never late. When I finally figured I had paid all that I had owed them I got my Lawyer to contact them. They used to call every day and harrass me. I felt from the beginning that this company had some very bad Business dealings. Their paperwork they fianlly sent me was not in order. It is not a Company that I would refer my friends to that is for sure.

No service
This is our SECOND dealing with this so called Mortgage Company. First time we were in the middle of a refinance when our loan was sold to them They claimed never to have gotten a payment from us...even though we had the returned check and they had cashed it. Our loan was sold BACK to the original company we had our loan through...and sold BACK to these fakes in Aug of this year. I cant get hold of them by phone...they have sent NO welcome packet OR statements...when THEY call it is all automated. And for some reason my payment has gone up over 1000 dollars I think SOMETHING needs to be done here...before we all go down in flames because of a bogus company. If a class action suit is begun PLEASE include me

Fraud
My complaint is against MGC mortgage. My loan was sold from Bank of America to them in July 2009. I paid my last payment to Bank of America and my first payment is due to MGC Mortgage on September 1, 2009. I have tried to contact this company at least 10 times to no avial, in fact I have only gotten a recording asking that I leave my name and contact information but I've never received a call from them. I'm terrified to send any payments to these people as I have not received a payment booklet and any other written information about them or my loan. I want to join in on the group that reports these people to the authorities as I'm afraid of sending money to a company that seems not to exist. I can't help but wonder why my previous lender would sell loans to a company that handles business this way unless they are in cahoots with them in causing people to loose their properties. I'm going to do whatever I can to expose these people starting with this e-mail
