Fraudulent use of return - failure to refund Acai Nutraburst
Took free trial of Acai Nutraburst for 30 days and was told by my physician that it may interfere with medications I have to take. When I called to cancel the product they had already auto shipped bottle #2 and I requested cancellation and a full refund. I was told that I could only be issued a partial refund of 49.90 once the product was returned at my expense unopened. I paid to have it sent return receipt and it was received there on September 16, 2008. I called to verify this and was told my refund would be coming in the next week. When it didn't come, I called again and they claimed they were having trouble with their credit billing and lost all information. Then I was told to do a "chargeback" on my account or wait until the issue was resolved. I waited, not eager to give them any more information. When I called back the next week, they told me that I would be receiving a full refund that week. I cautioned them that I returned the product due to unable to use reasons and they stated that would be fine. I have still received no refund. I called last week, October 17, and was told they were having a few issues but they would put a partial refund through that week and to call back in 3-5 business days. It is now October 26, and I call the customer service line. Joe, the rep, who refuses to give me his last name or let me speak to anyone above him, as he claims there is no one else, informs me that I am not entitled any refund due to a 30 day return policy. I state to him that I did return the product and I called and I even got an RMA number. He tells me I am entitled to nothing but if I want, they can send the product back to me. What the hell do I want it back for? He suggested I give it to someone else. I again demanded to speak to someone else and he refused to give me any phone # or let me speak to anyone else. I got his "batch" # and wanted to know how I can call for nearly six weeks and get the same "bad information" as he calls it and they can do nothing about it. He said, "you probably did" and I was still not entitled to a refund. This is absolute fraud. I returned the product in the time frame allotted and even spent money on the return and now I get no refund and unprofessional, useless, call center "customer service". I will appeal to the company ownership if I have to and obtain legal counsel. I am sick and tired of these punks trying to rip off we the consumer that follow all the rules and do the right thing.
