I never received any notification from First Consumers National Bank. I pulled up my pay information and was being garnished. I called and found out that it was from some attorney Mary Jane Elliot, in Novi, Michigan and I never received a piece of mail from her. Some nasty woman answered the phone and told me that I was sent mail to my ex-husband's address (we've been divorced for over 7 years) and I never resided at his address. I am contacting an attorney that represents the UAW today. This is outrageous and done without prior notification. I think that it is terrible the way the legal system works, allowing someone to sue a person and the person isn't notified.

I was never personally served, I did call them and tell them about the illegal part, then proceeded to offer to pay only what I origingally owed. They refused to work with me. I have offered to pay What I really owed to the Co. and the last collector (Midkland told me it was already charged off). I tried to ask for help before being late the first time and they said "no, we will make more money if we don't, and we always get the money". This was by the original creditor. I got a notice when it was to late about court, and could not make it. I am now sending a Request to open Default Judgment. What else can I do?? Thank You

I can home to find a (what appeared to be a) summons taped to my front door. I have not been previously contacted by this company. Yes the dept is ligit, but now they are serving a summons without previous contact? I feel like they are trying to bully me into payment instead of working something out

I have also received a summons from the local sheriff's office stating I am being sued by Midland Funding. Since I have been doing some research, I learned that they have bought my account from someone else. I got a copy of my credit report trying to see if I could figure out the original creditor is. I found two accounts on my report for the same exact amount. One is Midland and the other is presidio/CM, no clue who they are. This looks like a double reporting for the same debt. I will be contacting the credit reporting agencies disputing them both.

I have prepared my answer that will be mailed certified return receipt asking for full disclosure on the original debt, any documentation of the debt etc... on the presidio/CM listing on my credit report is shows my last payment date of 4/2004. Oddly enough Midland Funding did not report a last payment date. In Alabama, correct me if I am wrong, the SOL is 3 years... even if it is 4 years they are out of luck.

My question is can someone point me in the direction where I can find out if Midland Funding LLC is registered to do business in my state? I read on another website where one guy researched and found out they were not registered in New York and the judge threw the case out.
