Bank of America still showed I owed $86,828.42 for a house that already short sold
lost my job due to a car accident in Dec 2005, was disabled for 4 months and decided to ask Countrywide who owned both 1st and 2nd mortgage to approve a Short Sale. The Negotiator of Countrywide Adam Herson accepted the Short Sale with a condition that the Short Sale will only be approved if the escrow closed and that there will be no deficiency judgment against us will be pursued. The escrow closed, we have a letter and copies of email flrom the Negotiator that the balance of $190, 000 is cancelled. Last Year I have checked my Bank of America online and found out that Bank of America added to my account aciatn account called

Mortgage 5013 showing this balance. of $86, 828.42 as owed. As of this day, this shows as owed.

I have cataracts, osteoporosis, asthma, GERD and didnt have insurnance because Kaiser terminated my medical coverage due to co existing disabilities
. I am now in pain due to frozen shoulder and has not recovered since Dec 2006. Your help is greatly appreciated, thank you.

Property Insurance
Bank of America has adopted a new policy regarding the amount of property insurance carried. They have deceided that if you have a flood policy in place, then the amount of coverage must equal that of your homeowners insurance. It doesn't matter if your home is flood resistant and that the current amount of coverage is greater than the appraised value of the home. FEMA only requires you insure your property for the lessor of the replacement cost, the mortgage amount, or $250, 000 for single family residence. My mortgage is less than $100, 000. The home appraised for $130, 000 and I had $180, 000 flood policy. My homeowners insurance adjust each year for inflation (another rip off) and now I have to increase the amount of coverage on my flood policy. When I called to complain, Bank of America said that I could lower my coverage to the amount of my mortgage, all they cared about is that the coverage is equal.

I work at a community bank. If we adopted a policy like this we wouldn't have any customers left. I would leave if I could, but I can't afford to refinance. It would be pointless if I did. BoA would just end up buying that one when it hit the secondary market anyway.

promiss of modification never happened
I had a loan that was bought out by Nationstar, I had a 3yr arm and could not keep up when they started going up on the payment it was up to over $2ooo.oo a month for my mortgage payments, I did a modification with them they gave me the mod knowing full well it was still more than I coudl afford, I had no place to go and needed a home so I signed like an idiot, I made the payments best as I could, then last September they offer me another modification based on my income alone it lovered my payments for 3 months to an amount that I could afford, then they would look at it and see how well I made those three months payments. Well before the three months were up I got a letter stating they were forclosing that I did not qualify for the bail out they had promissed. So I got help in my town someone who know the ropes and could talk to them. The company said that I needed to make one thousand more a month. After all that I went through after making payments on a loan I could not afford eating one dollar Wal-Mart pizzas for dinner every night for 12 wks just to make sure I got my payments in on time. I am told that I had to pack up and leave. I get everything out and I get a bill stating I needed to make a payment of two thousand dollars to bring my loan current. Why would I do that if they are only going to take the place away from me??? They are a case of one hand not talking to the other and they do not help people they hurt people. I got the letter from them they were forclosing on December 12 of 2009 it was the best Christmas gift to get... Nationstar does not help they hurt I got another job and was abnle to make the payments they had suggested and still they said they were forclosing. I got six letters from thier attorney stating I had to pay up or get out. By paying up he said I had to pay the whole amount owed to them, Also; I was told every laate charge would be dropped and it wasn't dropped it was added and the 180 thousand dollar loan I had gotten to get the house is now 217 thousand nothing I paid went towards the original loan. I had been paying for 7years.

Mortgage payment stopped after paying off second
About 2 months ago I paid off my second on my house. Loan number: 8259798893. I advised Equity Accelerator that my loan on my second had been paid off and that they could stop my automatic payment on my second. Well somebody at the Equity Accelerator made an error and stopped my mortgate payment from being paid to GMAC. I was advised this by Malcom on 2/18/10. The reason I questioned this was that I received a letter in the mail from GMAC Mortgate that I should be working with the Loss Mitigation department on a special forbearance or other foreclosure prevention alternatives. GMAc advised I was behind 2 months on my payments. I almost had a heart attack. And then the letter said due to the unresolved delinquency on my account, I may be experiencing temporary or permanent financial problems that led to the defult. I did nothing wrong. I paid off my second approx. 25, 000.00 and somebody at the Equity Accelerator program made an error and closed off my mortgate coming out of my account which made my house delequent by 2 months. I tried to call GMAC and the lady was rude and would not even listen to me. Alls she kept saying was something regarding defult and reading something over and over. I started raising my voice trying to tell her what had happened. I then asked for a manager. She put me on hold and then sent me over to a SPANISH recording. I hung up and that is when I called Equity Accelerator. Malcom, a very nice man explained that he sent a letter to someone advising it was the error of Equity Accelerator and that I should receive a letter by the next day. When I called Equity Accelerator I spoke to Tina (?) who advised me that the letter was rejected due to the fact that Equity Accelerator was not going to take the blame for any delequent or last charges and my credit. Number one I have excellent credit. The highest credit you can get. My complaint is that GMAC would not listen to me about what had happened. They were rude, would not listen and just kept saying something over and over again that I was
deliquent and I owed 2 months payment. On February 18, 2010 I overnighted 1603.42 to GMAC's Louisville, KY office to I could get this account up to date. I have been advised by Malcom (2/18/10) that I was back on the Equity Accelerator program and he was sorry about the error. My question is, is this the way consumers are treated for paying off their second on their house? Is it by stopping the Equity Accelerator program so they can try and take somebody's home. I am asking for a letter that they made the error since Malcom eith Equity Accelerator advised me. When I spoke to his boss JR he gave me a fax number of 888-690-2006 and told me to send them a letter. I am very upset. Well, our zoning changed September of 09 in our area to a flood zone. We were not aware of this. AHMSI notified us right before Thanksgiving that we had to get this coverage. Alright, so we put in a call to our State Farm Rep. She told us to get an elevation certificate. So, we ordered the survey be done to get the cert. for insurance. We received the very next day after Thanksgiving a letter that was dated the day after they notified us of the zoning change that they took insurance out on us for flood. Furthermore they backdated it to August. This was even before the zoning had changed. Well, I called the mortgage company; their own employee told me he doesn't know how they could do this. He said by law FEMA gives you 45 days after being notified. I forwarded the papers to Financial Regulation to look into it. We since acquired refinancing through a new company. In these times big companies are looking ways to take advantage of us. Especially, if you're a lady or elderly. So, be careful. There is State Tax people and other Departments, usually in you phone book, which will help you not be taken advantage of. Guess they won't be getting my $700 per month interest.

possible fraudulant activity
I began a mortgage modification process with AHMSI in Nov, 09. I was very sick and had to have surgery. Since I was self employed I knew I would need to modify my loan in order to stay current with my payments. I hired a law firm called Alliance Law Center headed by Cameron Edwards. They were unable to get AHMS to communicate appropriately with them . In Sept, 09 Alliance Law Center was shut down and the lawyers involved had their licenses revoked. I notified AHMSI, via faxed letters and phone calls, to let them know I was now going to represent myself in moving forward with the loan modification. Since Sept 1st 2009 I have sent three letters to them requesting them to remove Alliance Law as the authorized communicator and reinstate myself. To this date they still refuse to communicate with me regarding the loan. They continue to say I am represented by Alliance Law Center and therefore they cannot communicate with me regarding the loan. They have asked me again today to resubmit the letter. They do admit they have the other letters I have submitted reguesting removal of Alliance Law. Something is very wrong here. I don't know what their ulterior motives are but it is obvious something is very inappropriate. AHMSI states they cannot tell me who is the lender now holding my loan ( It was previously American Home Morgage) They finally gave me the address of AHMSI ( after several phone calls and my refusal to stop calling until they gave me the address) It is 1525 South Beltine Road Coppell, Texas, 75019. I am sending all my Profit and Loss files, bank statements and tax forms to them even though they are refusing to communicate with me. I am moving forward with my end of the loan modification process and am keeping a very good paper trail ( I have written down the names and employee numbers of evey person I have called) I know I am within the parameters to get my loan modified. Now I just have to wait and see what they will do. I suggest anyone who may be having similar problems as me with AHMSI to persist aggressively with them and file complaints in every avenue they can find to file. A good friend of mine recently lost his home because of the same problems. He never recieved any information and then one day someone came to his door and his home had been sold out from under him without the required legal due process. I think we must all be very very careful these days. There is so much corruption out there and so many companies are acting with fraudulent intent.

Misleading/Unprofessional
I scheduled an appointment (on 5/16/2009) to see Robert Lavine after receiving a letter stating that i can refinance my house for 4.48% rate if i qualify. During my meeting with Mr. L, he checked my credit score, which was A+, then he asked me several questions, and for the info. i have provided Mr. L, he assured me that everything will go smoothly and i will have no problem getting 4.48% rate on my mortgage loan, so i filled out the paper work to have my house appraised. I agreed to pay $375 for house appraisal after Mr. L mentioned SEVERAL times that i will NOT have a problem getting this loan approved for 4.48% and after assuring me that everything was going to be fine and that i should have closing in just few weeks, i signed the papers given to me and was told i should get a phone call this week from the appraisal to schedule an appointment.Few days after, i received a phone call from Will Kasey, titled himself as Mr. L''s manager, and was asking if I''m satisfied with Robert Lavines service, and at the time i was. After two weeks, i received another phone call from Mr. Kasey asking if everything is going ok and if we scheduled the appraisal yet, which i had not yet received a phone from the appraisal. Finally, on June 1st i received a call from the appraisal to schedule a meeting on June 5th (3 weeks later). On Monday, June 8th, i called Mr. L to find out the status of my loan application and he told me that because of their computer failure his not able to retrieve the info. on the appraisal, but assured me that he will give me a call back after their computer system gets fixed. On Wednesday, i gave Mr. L another phone call after not hearing anything from him, and he mentioned that he was trying to get hold of me but had no luck, which i found that strange because i knew he never called me, so i was trying to get info. from him on the status of my loan and he hung up on me, i called him several times and no answer, i called the main number asking for Roberts Lavines manager and Mr. L answered instead, apologizing for getting disconnected, and told me that i was not illegible to get 4.48% but 5.35% because my house did not have more than 80% of value, i argued that he assured me everything was going to be fine, be Mr. L just accused me for things i have never said...I had no luck with Mr. L so i pursued to speak to Mr. Kasey (the manager), after several attempts on getting hold of him and speaking to other people that pretended to be Mr. L''s manager, i finally got hold of Mr. Kasey and explained to him my situation, he was able to find the value of my house right on his computer (which was $415, 000) so why didn''t Mr. L check the value of my house with the info. i provided him with and i would of told him right away that my house does not have more than 80% of value, so i wouldn''t of wasted my money on the appraisal that was not necessary. Mr. K was very understanding and told me that he will find out why Mr. L didn''t take the proper steps, why it took so long to get the appraisal done, that he will try to refund me the money we paid for the appraisal (they also overcharge me on the appraisal $415 when it was supposed to cost $375) and he will try to find a program that will fit my need in getting a mortgage loan. Mr. Kasey was supposed to call me the same day and never did, i called him in couple of days and days after with no answer, so i kept leaving massages and i never got any responses.I was mislead by Semper Financial by letting me know that i had nothing to worry about and i was sure to get 4.48% rate after i get my house appraised. Any other bank i went to prier, did not even bother with paper work and appraisal after checking (on their computer) what my house was worth, but this company wanted me to get the appraisal done just so they could get money off me.I got scammed, ripped off, lied to, and left with questions unanswered! This company did not take proper steps.

After going through all this hassle; being mislead, scammed, ripped off, lied to and received such unprofessional service, i do NOT want to do any business with Semper Financial but received my refund for $415 that i paid for the appraisal (which i was told by Will Kasey, Customer Service Manager, that i will get my refunded), i paid for an appraisal which i did not even need!!!

modification
I went to LENDAMERICA to get a loan modification, they said I was not eligable for the there program. They told me that someone is going to give me a call who will help me get my modification. Like a week or so after someone gave me a call saying I spoke to a Igor Lipkin at LENDAMERICA, who's name is Jim Macaan.

He promise me that his team definately can get me this modification, so I went along due to the fact that he got my infomation from LENDAMERICA, I felt thi would be a safe transaction. $1, 950 that is what I gave to them. The address I went to is : 6901 jericho Turnpike suite 245 Syosset, ny 11795.

fraud
I was using apply to save for a mortgage situation in nov.2008 I was told that apply to save coul not help me, due to my house being in foreclosure. In dec.2008 they had made it a cancel and were supposed to refund me my money which was 750.oo by march of 2009, I called and search for them today again.. june 4th 2009 and their number is diconnected and website not working. tha's messed up as if we didn't have enough problems.. right!!! May God forgive them..

late charge on credit report
The bank of america has my 2nd mortgage, It is an automatic payment, They also handle my bank account and have my permossion to subtract the amount of the mortgage on a monthly basis, they have reported a 90 day late on ONE DOLLAR! and I am having problems getting a fair credit rating, and or a good refi, can anyone out there help with advice, Leonard
