On 9/6/09 I signed up online to mxenergy’s gas service for 6 months (10/7/09-4/6/10) with no termination charge. On 12/30/09, I received a notice of renewal for another 6 months (4/7/10-10/710), so I let the agreement renew. Since I did not receive another renewal notice when this agreement ended, on 9/6/10 I made a commitment with another gas provider.
Now mxenergy claims that a renewal notice was sent and that by my not responding, I had renewed for another 6 months. (How could I have renewed by doing nothing for something I did not get???) They now claim that I canceled the agreement and owe them a termination fee. After their making multiple threats, I was forced to pay them $29.95 for canceling an agreement that I never made. I thought that a contract resulted when there was an offer and an acceptance of the offer—I did not accept an offer but they claim that I canceled something.
This method of contract renewal is unfair since there is nothing to prove whether or not an agreement was in effect.
