One of the many new "Mass Joinder" lawsuit/foreclosure avoidance litigation companies, they claim to be a "non-profit, " based in Utah, that is "going to file" a Mass Joinder lawsuit against each of the major banks, under the leadership of John Markham, of Markham and Read, Boston. They want $10, 000 UP FRONT, which is illegal in the state of CAL., where they are soliciting and where they plan to file the suit. They have not filed any mass joinders so far. When I and another participant asked on a "conference call" about the DRE FRAUD WARNING for these companies, they shut us down, fast. Two minutes after the call ended, a very angry salesman called me and used the F word at me, for "ruining his relationship with other clients." Read: he lost a few commissions on that phone call, when I mentioned the DRE warning. In addition to the thousands of dollars upfront, they ALSO want "contingency fees, " if they win, 10% of your mortgage savings. They say their ultimate aim in every case is to "release the lien" on the house, so that you in effect get your house free and clear. Or, they say, they can get you a new deal for "80 to 100%" of current value. As far as I know, they are asking for more money upfront, illegally, than any other outfit out there. Even with the lawyer loophole, the DRE states clearly that they must put any monies paid upfront into a client trust, which they told me they were not doing. I found out "NAFDA" formed less than a year ago, but they are using this John Markham, of Markham and Read, to make them look legit. He works and lives in Boston, and is filing in CAL., but he has hired salesmen in UTAH??? Hmmmm... think I'll keep my ten grand, although we lost $550 on his "securitization audit." They wanted another $250 to prepare the "documents." We bailed, and the rep went from smooth and solicitous to angry and profane. Any way to get our $550 back? (At least we didn't pay the thousands!)
