phone calls
I purchased a car in my name and my Aunt co-signed for me. The car was taken and they have been harrassassing my aunt (the co-signer) NOT calling me direct or even sending me (the main name on the loan) anything in the mail. I moved to Tennessee and while my Aunt was still getting threatening phone calls for collection I went to the Creditor (Wells Fargo) and started making payment arrangements with them. In the last few months I had lost my job and moved back to Ohio and JUST started another job and my Aunt is getting phone calls once again. NOT ME but my Aunt... and they have my number plus my Aunt has given them my number so they would leave her alone but still no phone calls to me. I called and talked to a man at National Action Financial Services (Kevin) which told me he would give me until the 28th of that month to come up with a payment arrangement but to make sure of the amount I choose because if that payment wasn't made of a month then they could come back and collect for full amount with no payment arrangements. It's not even the 28th and now my Aunt gets a call from a Mr. Bona a few days later telling her that "in the notes" it states that I had hung up on Kevin when speaking to him and refused payment and there was nothing in the notes stating that he had given me until the 28th. This is a LIE... Now they are trying to have my Aunt pay half the loan amount to have her name taken off completely BUT that HER half of the amount is $8, 500.00 BUT they would give her a break off her half IF she paid $5, 000.00 up front and her name would be taken off all together leaving me with the remaining balance. If half is $8, 500.00 then all I should owe and make payments on should be the other half which is $8, 500.00 right? well NO, Mr. Bona told me that the $3, 500.00 they are giving my Aunt as a break off of her half of the loan amount will be added to the remaining $8, 500.00 of my half making me owe $12, 000.00. I understand I owe but if they are going to half that amount amoung us shouldn't my amount only be $8, 500.00 that I need to make payment arrangements on then? And another thing... The total amount of the car loan was $17, 321.05 and I made 14 months of payments so that should have been taken off that loan amount PLUS the amount they received for the car after they sold it. They are trying to pursue for the whole loan amount how can that be? He told me their was other fees included as for towing, blah blah blah. I have read many bad things against this company (NAFS) on the computer. Under the FDCPA Rules it states they can not add on any extra fees that the ORIGINAL credit or loan agreement doesn't allow. Does that mean they can not tack those other fees on to it? That's what I am understanding. We asked him to fax ALL the paper work stating the amounts and the final amount and he said if he did that then the aggreement for my Aunt would be voided that if my Aunt wanted to keep that agreement he proposed then he can fax the paperwork of the agreement papers stating her name would be off if she paid the $5, 000.00. Why is it too hard to see all the paperwork he could sure tell me them over the phone as if they were right in front of him. We are going to pursue with talking to a lawyer... beware of this company... They have lied to my Aunt saying I had hung up on them refusing to pay and it only seems like they are trying to play one another to only get the money. I want to get rid of the 3rd party and only deal with the orginal creditor to make sure myself but I guess we will see what the lawyer has to say. Hopefully it will get all resolved soon!
