Hi everyone,
They got me too..I own a company in North County San Diego and they called me to solicit their advertising. I agreed in June 09 to meet with them and he sold me on what seemed to be a "too good to be true deal". He said that I could have the cover and inside ad in 2 magazines for under $120/mo for both. The magazines he showed me had movie stars on them (Brad Pit on the cover) so they made it look like movie starts promote the magazine (the copy they sent me has Oprah on the cover). The magazines were to go into Boney's, Henry's and other whole foods stores. So, I waited and waited for the magazine to come out and it never did. I couldn't find my ads anywhere and the stores said they had no idea what I was talking about. I called NAC multiple times, however, I could never get through and no one called me back. Then all the sudden in Sept 09 I started getting charges on my credit card for over $400 each time. To boot, I made it clear when we met and on my contract that they could not charge my credit card and that I wanted to be billed. At the meeting the representative would not take a check and really pressed me hard for my credit card, which I thought was weird. I should have gone with my gut. So, recently, after these charges, I called and threatened to sue them, and suddenly a lady called me back and completely admitted that they had no contracts whatsoever with Boneys or Henrys or any other whole foods stores, but they did with a Ralphs (BTW-which was in a really bad area!). I told her that anyone can put flyers/magazines out at Ralphs and that I didn't sign up for Ralphs, especially in that area, and that they were fraudulent by selling me something that they didn't even have rights to. She agreed that my contract said Boneys on it and said she would get back to me, again, after numerous threats on my end. She said they would only give me my money back if I signed a waiver not to sue them. I'm anticipating getting a credit for everything, including the upfront money to have my ad created, so over $1,000. If I don't, I have lawyer who said he's sue them on contingency.
