Hollywood Video Debt Collection
National Credit Solutions sent a threatening letter received Jan 30, 2011 claiming they are a collection agency on the behalf of Hollywood Video who filed bankruptcy I believe in 2009 attempting to collect a debt in the amount of $124.92. I do not owe Hollywood video any money, therefore you can imagine how shocked I was to receive a letter threatening my good credit score that if I don't pay or respond within 30 days it will be assumed this debt is valid. I almost paid the money thinking I didn't have a chance or the time to prove this was surely a mistake. Something told me to investigate this company which I did, and found a gazillion complaints. I decided it was only right to dispute this so called debt I did not owe in writing through USPS certified mail. In the letter I demanded the following validation: show proof of what the money is owed for and what services were received, show me the details & calculations of how the amount was calculated, provide proof of judgment or verifications of any debt owed, identify the original creditor from whom the purchase was made, prove the statute of limitations has not expired on this debt, show proof of license to collect on this debt in my state, show the proof of debt collections right license number in my state, show that they are even authorized to collect on this debt on the behalf of the original creditor, show what the original amount was when this devt was assigned to the collection debt agency, show any fees and interest charges that have been added on to this debt, show how these fees were determined, and to provide an original copy of the original signed loan/credit card application/contract with the original creditor. Ha and behold, I received a letter today stating NCS would be remitting this file back to a client (who no longer exists) for further review. NCS is ceasing to collect on this account and are closing this account with their office. The letter also states they will request an update to the credit bureaus. I still may sue this business for not following the law under the following court case Fields vs Wilber Law Firm, Donald L. Wilber and Kenneth Wilber, USCA-02-C-0072, 7th Circuit Court Sept 2004. This company also did not follow the law under the Fair Debt Collection Practices. They reported fraudulent information to credit bureaus on debt that was never verified!!! If this debt was valid and verified, they would have taken things further to collect! I'm so glad I didn't give in to some fraudulent bully! Take the time to write disputing any debt these clowns claim you have if you truly know you don't owe Hollywood video anything. They may just get sued for defamation of character, not following the fair debt collection practices act and not following the fair credit reporting act. Shame on NCS! Also I recommend writing a certified letter with a copy of the certified letter sent to NCS to each credit bureau disputing any fraudulent debt collections attempts! Don't bother calling these clowns, they are rude and demand you provide proof of not owing, wrong, under the above acts I mentioned, they are responsible for providing proof you actually owe the debt. One more thing the letter I received claiming the collection would be ceased and closed debt went from $124.92 to $49.92, awfully strange isn't it. These people need to be shut down for their unethical practices!
