Misleading - Bait & Switch
This company is a scam. They are pulling the old "bait and switch" scheme and signing people up for recurring charges. They are unapologetic and difficult when dealing with their customers. This company gives all legit online businesses a bad name. My credit card company was more than familiar with them when I called about these charges.
I want my $79.96 refunded!

Nature's Acai Berry, Ultra Slim XS, Pomclear, and AcaiPure all share the same practices. Charge ridiculuous amounts of money for a product that can be purchased at Walgreen's for $11.95. I have cancelled the debit card I used for these companies. I am starting with dispute charges at my bank and if the monies are not returned, I will file a police report for fraud. The fine print is suppose to be a disclaimer for the product itself, not a statement that more money will be charged if you don't cancel the trial. And for those who have cancelled and still been charged, you really need to contact your local police and file a fraud statement. We all are out at least $100, not including the shipping and handling fees. This is the reason that some people refuse to purchase on the internet. Let's stop this. There has to be a way to put a pop up on their site to not purchase from them. If what they do it legal, the way to prevent them must be too.

Unauthorized billing
There is nothing 'Free' about this 'Free' trial. You are required to pay the $4.95 S&H up front. Then, if you don't cancel the 'Trial' within 14 days of shipping, you get charged the full $79.95 for the 'Free' bottle (you find this out in the Terms and Conditions link at the bottom). Call 1-800-983-7968 M-F, 9am-9pm, EST to cancel.
BTW, the 14 day 'trial' period starts when shipped, so the time enroute gets subtracted before you ever get your bottle to start the 'trial'. Then, elsewhere it states that most customer find results if they take it for 3 mo.! So how much 'trial' can you get in the 7-10 days you actually have before the 14 day deadline occurs?
But that's not all! If you don't also cancel the Diets Cental (aka Fitness Factory) 'membership', by the same 14 days you will be charged $29.95/mo. until you do cancel! Call 1-877-495-1182 M-F, 9am-9pm, EST to cancel.
But wait, there's more. If you don't cancel the Cost Wave (aka Cost Smasher) 'membership' by the same 14 days you will be charged $2.95/mo. until you do cancel!! Call (the same) 1-877-495-1182 M-F, 9am-9pm, EST to cancel.
According to the T&C's the Diets Central and Cost Wave are 'options' but we ended up with those 'memberships' without consciously checking off anything and I refuse to go back through the order procedure to try and find where those 'pre-checked' options are.
Suffice it to say the whole site is set up do take advantage of web customers who are trusting and don't read the fine print of the T&C's and who don't uncheck some 'pre-checked' 'options', IMO.
Of course, the Company Employee can claim that all the information is on the site (if you look for it). But the whole initial premise of 'Free' is totally bogus and the bait to suck in the unsuspecting. But customer satisfaction is their number one goal. Yeah, right!
It _does_ appear possible to get a refund if you remain adamant and state that you will be contacting your bank/credit card company and will file charges with them to get their operations blocked. The had to get their supervisors approval (short time on hold) then came back with the OK. They provided a confirmation number for each of the canceled 'memberships' and promised a refund would be made back to my credit card. We'll see if that actually materializes.
One other thing to watch. Since the 'Fitness Factory' and the 'Cost Wave' had the same 800 number I tried to cancel them both on the same call and the guy allegedly did that. But he only gave me one confirmation number and when the confirmation email came, it has a note that says '...only this membership has been canceled' (or some such), and it only listed one! So I called again, got a different person (another who spoke very poor English), and sure enough, one was still uncanceled. So they were working another scam, IMO, to get one more charge on the card before they got completely canceled out.
Bottom line, these guys are totally bogus and running a fraudulent scam, hiding behind their T&C's to prevent legal action, IMO.

Unauthorized charges with no ability to cancel
I was tempted by an advertisement to try the Acai Berry for free (only for shipping and handling) and recieved a "gift wrap, " just to find out now that i am being charged about $80 because I did not return the product within 14 days. I have been trying to call the telephone number given above but they keep me on the line and no one answers so there is no way to cancel the order.

I like so many others ordered the FREE trial of Acai Berry not knowing that this hooked us into a memebership which we had 14 days to cancel then I was charged $79.95 plus the original $4.99 for the free shipping. Then a second bottle comes and I am looking over my credit card and see $85 charged and then I see some lifeift charge for $29.99 which was also tied to this. I called and spent about 40 mintues getting the $85 refunded and cancelling all these supscripitions I never signed up for. We should have read the terms of use, WHO reads terms of use when all you do is think you are ordering a trial size bottle of an item, Oh and after fighting with this woman for 40 minutes she had the nerve to say I was a valued customer and would like to offer me this product at a reduced price. They could not pay me to take this product. I am going to pursue this with my credit card company and hope I can get some help there to take off some of these charges. This has to be illegal somehow.

Fraudulent Business Practices
I followed a link from the Rachel Ray web site (who can you trust more than her!?) to get a FREE sample of the Nature's Acai Berry. The free was in huge type, probably 60 pt. The ONLY charge mentioned for the sample was the shipping of $4.99. The product arrived and I opened the bottle, but used none of it. Then on March 12, there was a charge on my account for $79.96 from this company. I called and was told that when I submitted the order a email was sent confirming the order and containing the "terms of agreement" stating that I had to call them within 14 days to avoid being charged for the product. I never received an email and told the rep. so. She said that even so, that when I placed the order, the terms of agreement were on the online form I filled out. I would swear this was untrue, but it's my word against theirs. I was told that the account could be closed, but nothing could be done about the $79.96 charge. I asked to speak to a supervisor and was told that I could, but that they would say the same thing. However, it was better than that; the supervisor hung up on me. I called back and spoke with a different rep., who said that their computer reflected that the supervisor "accidentally" dropped the call. I was also told, that since the bottle had been opened, that I was stuck with the $79.96 charge even though I was totally unaware of their "terms of agreement". I believe that when an offer says FREE, then it should be free. Nothing should be free for two weeks, then worth $79.96 because a phone call was not made. That was money I could ill afford on a product that may not even work and was certainly overpriced.

Misleading Advertisement
I have read over 100 complaints that read all the same. Unfortunately, I made the exact same mistake that everyone else did before I READ ALL OF THE COMPLAINTS. I ordered the "free trial" and got charged the $4.99 shipping and handling charge. And, I am fine with that. Once I received the produtct I looked at the paperwork that was sent with the product...AND nowhere does it say anything about calling and canceling within 15 days. And not even 10 days after I received the product, they charge my credit card $79.86. First off, the stuff isn't worth that much anyway. And secondly, they give you nothing in print that tells you that you will be charged additional money if you don't call within 15 days of placing you order online.
This scam is just about a ruthless as the scam that some of the magazine companies run on you. MY GOD $80 a bottle...that's two months worth of gym membership and a hell fo a lot of Healthy Choice meals.
Fortunately, I sit at an extremely powerful level of the government and I am going to do EVERYTHING in my power to see that companies like this are made to pay. I certainly hope that someone from this company reads this and take this as a wake up call because the next steps are going to be EXTREMELY unpleasant for them. With the current state of the economy, no one is going to tolerate scams that cheat people out of their money due to fine print.
And to compound the insult to injury, when I did call to cancel my "membership" the lady was trying to sell me more CRAP. The product may be wonderful, but the way that they market the product is EXTREMELY misleading. Please, Please, Please do not do business with these people. If I collected $1 from everyone that has been scammed by this company I would be rich. I'm not sure where this will lead, but I am not going to give up until I find the person responsible for this...May God help them when I do.

Diet Supplements
This company is a fraud and the people who works there are SCAM ARTISTS!! In this economic climate, with what we're going through trying to hold on to our homes, jobs and whatever money we have to survive, these people are out here preying on people who are looking for help to lose weight.
To add insult to injury, the customer service representative had the audicity to tell me there was a fee for cancellation! Are they kidding?!! With the unauthorized charges to my credit card along with shipments they don't send out, these people have unloaded another scam on the unsuspecting public. I have every intention of filing complaints any and every where I can!! I WANT MY MONEY BACK!

Unauthorized billing
Not only did they charge my debit card $79.86 but after I tried to get a hold of them they took my name and number due to having high volume of calls. They are also located in the Philippines. They also had me signed, without my clear knowledge, for 2 other memberships. They say there is nothing they can do. The $1.99 shipping fee only pays the shipping. If they don't hear from you within 14 days they'll charge the full value of the bottle. The problem is the stuff made me very sick and they refused to give me my money back.

Fraud and scam
I purchased this product, according to thier records, on 2/21/09; they billed the shipping charge to my account on 2/24/09. I received the product on 3/6/09, the 14th day after placing my order. The very nature of a free trial period is that one is able to try the product, which I was not able to do. On 3/9/09, they charged my account $79.96 for "replenishment". When I phoned the company on 800-983-7968, I was told very sorry for your concern, but you have to phone within the 14 day trial period to stop the charge, and they cannot reverse the charge even though I did not receive the product to try. The only website information available is about billing.
When I went back to the website that I ordered through to look for a different telephone number or mailing information (or something!) to get further assistance, I found that the website I was directed to to order Nature's Best Acai Berry is actually somebody else's website! Not only is the service a scam, but the company is acting fraudulently by using someone else's website. The website I ordered through is actually Acai Berry Maxx, but their tech guys found that somehow Nature's Best is redirecting back to themselves through Maxx. Maxx are in the process of tracking the information back to find out how to stop this.
When I phoned the 800 number to Nature's Best again to let them know that the jig is up, they had very conveniently lost all of my account information. It's as if I never existed, but they sure as shootin' have my money, and I don't know if I can get it back. I will be filing an unauthorized charge with my bank to see if I can get the charge reversed.
DO NOT buy from this company. Report this company to the Attorney General's Office for fraud. Get this company off the internet, and get them to stop.
