mail harrasment
I am almost positive the Statue of Limitations has expired by many years on a judgment [ credit card ] that this collection agency is intensely perusing via telephone and mail. The last activity on this account has been well over 10 years and I believe the statute time in NJ is 6 years.
I am caring for two ill parents [ my mother is fighting terminal cancer ] in their home for many years.I have not been employed for 3 years and own nothing of value. Their constant calls and letters [ last one is threatening me with arrest] are adding to an already stressful house hold. I dont know if this can make a difference or not, but thought Id at least make an attempt. Forgive me if I am mistaken about the statute of limitations for NJ. Thank you, James West

Fails to prove debt oblgations
New Century Financial purchased a debt and attempted collection of the debt from me that is not my debt. I was not very up on my rights and didn't know the laws so when they kept harassing me I started making payments even though I knew it was not my debt, they were threatening to contact my employer and attach my wages, seize my personal property so I felt I had no other choice but to make payments. Then I became ill and could no longer make payments So they teamed up with Pressler and Pressler and got a default judgment against me even though I filed an answer and was waiting for my day in court. I filed to vacate the judgment but even though I demanded proof in the court papers that they prove I owed the debt they were collecting on they still did not have to prove it and the judge didn't even let me talk or try and defend myself, in the end they were awarded a judgment for over $6, 000.00. The account they purchased was an old Credit Card with a credit limit of 1, 000.00 that was on my credit report, but the account was not mine and it was eventually removed by all three agency's once I disputed it. I am at my wits end, how can they get a judgment #1 on an account they had no proof belonged to me #2 for over 6, 000.00 on and account that's limit was 1, 000.00, the law states they can not do either but they continue to get away with it. I am unable to work due to a career ending illness so I do not have the money to fight these sharks... but I will not give up. I am hoping to get my story out and hopefully sooner or later some attorney will file a suit against these losers.
