I had been working with this individual regarding a settlement that Bank Of America sold off from my credit card debt. I had been waiting for a wire transfer from a relative to pay this off. I received a call Wed. the 25th at my place of employment. I told this individual I could not speak to him at the time and I would call him back. Well Thursday I received a call from this individual who proceeded to use abusive language.

He told me I was ignorant, irresponsible and that I needed to grow up and why don't I call people back. Asked what I had left to show from using the credit card, old clothes, pictures? Told me to go home and look at myself in the mirror and say that I am partially responsible for the economic state of the nation. He demanded to be transferred to my HR Dept. so he could tell them what an irresponsible employee they had.

If I would of been thinking clearly, I would have transferred him to the fax machine. As the conversation drug on, he pressured me to borrow MORE money from the relative that lent me an initial downpayment. He says if I could get 1500.00, I could get 1000.00 more.

I told him I contacted the Bank of America which I did, and he called me a liar. I read off part of the e-mail I received back from BOA. He told me to start crying my tears for in front of the judge and then wait until they garnish 500.00 from my wages. He yelled at me asking 'where is the 2500.00 Ms. Doe, where is the 2500.00?'

He told me I was recorded admitting I had spent the money but I was never informed that any conversations were being recorded. I believe BY LAW, I should have been informed prior to the conversation. He proceeded to degrade me so I had a co-worker come over and listen to what he was saying to me. That's not a recording is it?

He kept going on and on, blah-blah-blah-yada-yada so I just hung up on him. I then called back and was passed to his Supervisor who was as classless as the other guy. He raised the amount by another 1000.00 to which I replied 'Is that your cut?'

I told him I was waiting for the wire transfer which turned out to be a problem due to the routing number being incorrect. He wanted to know why a check was not mailed or why it was not sent overnight Fed-Ex. Said I was blowing smoke up his ass claiming I didn't have the money nor even planned to. He says he will give me until Saturday then hung up on me.

I immediately hired a debt collection lawyer and he says I have a good claim against this guy for abusive and unfair debt collection practices. On a side note, people like that need to maybe think before they go off on somebody. They don't know what kind of ties their 'victim' has nor what resources they have available. I intend to pursue this to the fullest extent so this guy will have no future in this occupation. How does he sleep at night?
