Hereby notice is given to all concern that a Division Bench of the Hon’ble High Court Calcutta presided over by the Hon’ble Chief Justice has passed judgment that; “decision of this Court, which bans slaughter of cow on the occasion of Idd as a religious ritual. was upheld by the Supreme Court (State of West Bengal vs. Ashutosh Lahiri, reported in AIR 1995 SC 464), still holds good. The Authorities are, therefore, bound to implement the provisions of West Bengal Animal Slaughter (Control) Act, 1950 and if any instance of cow slaughter on Bakri-Idd is brought to their notice, they will have to take cognizance and act in accordance with law. ….. It will be open for the petitioners to move this Court in case they come across such incident and if the same is reported to the authorities and the authorities fail to take any action in the matter.”
Above mentioned Judgment has been passed in W.P. No. 1378 of 2010 Abhijit Das &Ors. Versus The State of West Bengal & ors. Along With W.P. No. 21591(W) of 2010 Enamul Haque &Anr. Versus State of West Bengal & Ors. Be it mentioned herein that the previous Judgment which has been referred in aforesaid Judgment dated 12.11, 2010 is the Judgment passed in Kedarnath Brahmachari & Ors vs. The State of west Bengal & Ors reported in 1982(I) CHN 273 wherein Ashutosh Lahiri was petitioner no.20.
Be it known that like cows said Act grants equal protection to Bulls, Bullocks, calves and Buffalo calves. Police & Municipal Laws also provides for confiscation of such animals kept in violation of such laws for transportation, sale, as also for sale of produce thereof and the Animal Slaughter Control Act, 1950 totally prohibits slaughtering of aforesaid animals of any age on one’s own sweet will in contravention of the Act at one’s home, on road or here & there.
Therefore it is statutory duty of the concern police, municipal and civil authorities to ensure compliance of said order and the Acts and take steps to prevent the commission of offence of slaughtering of cows, bulls, bullocks, calves, buffalo calves on Bakri Id Day or any other day as it is cognizable and punishable offence as also to see that no illegal transportation, gathering, sell and purchase of the cows are done within their jurisdiction as also to confiscate the aforesaid animals which are kept at home in violation of the statutory provisions, otherwise everyone has legal right to lodge F.I.R. with police and move the Hon’ble High Court with evidence for getting authorities concern punished for commission of Contempt of the Hon’ble Court by not preventing Cow Slaughter as per direction of the Hon’ble High Court.
