Nu Union repeatedly takes out NSF/overdraft fees from my personal checking account when there were sufficient funds in my account. Not only did I have sufficient money in my account from a deposit I made that day, I also have over draft protection
The most recent example occured on CU charged me two $28.00 NSF fees on 12/1/2009 at 6:03:44 and 6:03:45 p.m. respectfully as indicated in my check register. I made a deposit that same day at 5:22:18 p.m. almost 45 minutes before the two checks were put through . When I pointed this out to Nu Union, I received the following explanation.
"The checks were presented for payment at 5:07 pm and the deposit was not made until 5:22 pm. You cannot see pending transactions via Internet Banking; only transactions that have actually posted to the account. The fee are legitimate, the funds were not available when the checks were presented for payment."
Of all the hair- brained, trumped up responses. My check register clearly shows the checks were cleared at 6:03:44 and 6:03:45 p.m. this is the recording of these checks in NuUnion's own system. So in other words they are admitting to falsely reporting the time checks clear in the register and/or they are charging NSF fees for alleged "pending" transactions. They cannot provide proof of the alleged "pending" status but can show when the checks went through. Explain to me how this activity is not criminal/fraudulent on Nu Union's part. They cannot be allowed to get away with this. Lastly, what is the purpose of overdraft protection, not only did they not clear one of the checks (a check for $5.00) but they cleared the check for $50.00 and I have overdraft protection for $200.00. Tell me how this is logical? I never heard of overdraft protection picking and choosing which checks to clear and only clearing some, but not all checks up to the amount of the overdraft protection. This is down right criminal. Please look into this criminal activity and make this credit union pay it's members back including me of course, the fees they have stolen from me.
