No cash back on purchase which did not fit
I have bough two pairs of socks from a Chinese shop in Birchleigh, Kempton Park. They have a small note on the wall stating that they do not give money back on purchases but that we can exchange if not happy. At the time of buying I did not worry about that part as this was socks which the sales lady ensured me this is a size which will fit all! When I got home and tried the socks it did not fit - the top ribbing is to tight and when I return the socks the following day to exchange for a bigger size I was told that they do not have a bigger size and that the size of the socks is standard fit-all size. I was then told by the sales lady to exchange my purchase for any other items, I did try a few items on but also these items are also not to the South African trade to fit - the clothes I wanted to exchange for also did not fit. I then ask the lady for a money cash back (which is only R50-00). She refuses and when I request to speak to her "boss" (this is now the Chinese lady who owns the shop) I was told that it is not possible, and she also refuses to give me her cell number to take this matter up with her. I told the sale lady that it is unacceptable that I MUST exchange my purchase for something else, and there is nothing inside there shop which is fitting me, so how can I do a fair exchange. I told her to make an appointment with her "boss", which was also refused. She phoned her "boss" several times in front of me and she keep on giving me the same answer - EXCHANGE NO CASH BACK - and the boss refuses to see or to speak to me. I requested her to ask her boss to tell me how can I exchange if their is not a bigger size, and if there is not something that fits, how can I exchange? She just pulled her shoulders up and said that is how it is. when I reported this behavior to the management of the shopping centre, I was informed that they can not pass on any contact details about the owner of the shop, and that I am not the first customer to complain about the sizes and the actual fittings of the clothes which are for sale in the shop, apparently they received at least 3 complaints about the very same shop and thing per day! What is my rights, must I now just sit back with a pair of socks (R50-00 worth) which I cannot wear or will the consumer board be able to help me.
