I have had 5 or 6 positive experinces with this site up and until my last parking experience. My car was vandalized sometime between drop off on Oct 9 and pickup on Oct 17- the rag top on my convertible slit from side to side and contents of my glove box emptied on floor of my vehicle. I was handed a card with information to contact the local police to obtain a copy of the vandalism report. I was also asked for information to pass on to their Insurance Carrier.
I received a call today from Jennifer Elkins - (813) 636-5360 denying my claim on the basis that this facility is a Self-Parking and because your keys are not passed on to an attendant - the liability remains with the vehicle owner. In legal terms - in parking at this location the agreement is a "contract of adhesion" or take it or leave it!
So the following claim in their advertisement " We understand that youre not just parking with us; youre placing your trust in us. Put your mind at ease with gated and well-lit parking lots"(http://www.pnf.com/index.htm) is consumer fraud!!!
Do not park there unless you assume that risk!
I am at a loss on how to proceed - short of licking my wounds - paying my $500.00 deductible and moving on. The part that annoys me is that other consumers will face the same powerless fate.
At a minimum this company should be required to post signs - prominently at the entrance gate, on their reservation - online site, and on premise to make consumers aware that "they are parking at their own risk and are assuming full liability". This company should not be able to continue to profit on such false and misleading advertisement. Their obviously is little or no security at this location or remedy for lapses.
