Government Actions

On November 19, 2009 Devon S. Howard, R. Scott Leckie, Peritus Financial Services LLC, Quality Wholesale Homes West LLC and DSH Management Services LLC were added to the Utah Division of Consumer Protection Buyer Beware List for having committed deceptive acts or practices by soliciting or entering into consumer transactions with persons who lack the mental ability to comprehend the nature and consequences of the transactions; failing to make refunds to consumers within 30 days of receiving valid requests for refunds; failing to ship goods or furnish services within the time represented after receiving payment; conducting business regulated by the Credit Services Organization Act without first securing a certificate of registration and posting a bond, letter of credit or certificate of deposit; charging or receiving money or other valuable consideration prior to full and complete performance of the services agreed to; and making or causing to be made untrue material statements, or failed to disclose material facts necessary to make statements not misleading in connection with telephone solicitations.

On September 1, 2009 the Utah Division of Consumer Protection issued an Final Order by Default against DSH Management Services LLC, Quality Wholesale Homes West LLC, Peritus Financial Services LLC, Devon S Howard, and R. Scott Leckie ("Respondents"). The Respondents were ordered to cease and desist from: a) failing to ship goods or furnish services within the time advertised or otherwise represented after receiving payment; b) conducting business regulated by the Credit Services Organization Act without first securing a certificate of registration from the Division and posting a bond, letter of credit or certificate of deposit; c) charging or receiging money or other valuable consideration prior to full and complete performance of services Respondents agree to perform for buyers; d) making or causing to be made untrue material statements, or failing to disclose material facts necessary to make statements made not misleading in connection with telephone solicitations; e) failing to make refunds to consumers within thirty (30) days of receiving valid requests for refunds; and f) any act in violation of the Utah Consumer Sales Practices Act, the Credit Services Organization Act, and the Telephone Fraud Prevention Act. The Respondents were assessed and ordered to pay an administrative fine in the amount of $87, 500.00.

How come the state gets money that it wasent out, Where is our Money we are out??

Rip Off Company
I went to th QWHOMES website and filled out an application, I got a call back saying that I was approved for a loan. We just had to get our credit mend from Peritus Credit Services. The person we contact was [email protected]. We also put a downpayment for $4000. We have not heared for anyone and the numbers that I have been calling are busy. We start dealing with QWHOMES on 6/05/2009, once we signed the texas retail sales contract. This company it truly a rip off. I just hope that they can get caught before alot more people lose anymore money from this compnay.

Breech of Contract
I was searching around for a manufactured home and found Quality. They told me I would need some "Credit Mend" and I would need to put down a deposit with them. I started with $1000. This was supposed to continue month after month with direct withdrawals. I did do some research on them before I signed the contract and gave them the money. I found very little negative about them. I didn't look deep enough. Well I suddenly had a hard time getting a hold of Brock Henning, the salesperson. Then it took several days to even get a call from the "Credit Mend" people at Peritus Financial. This is another rip-off company of course. Just before my first installment was due a month later I get an e-mail from Peritus with some bogus paperwork. I guess this was to keep me on the hook. I had already shut down theaccount that they were to pull from. I have heard nothing from them since. All calls go to some recording saying they are having phone troubles and the website is "Under Construction"

I spoke with Brock concerning a modular home and he had me send in a down payment over the net. He wanted me to some papers but I didn't and neither did my Mother. After receiving the money I no longer heard from Brock and could never get in touch with him from then on. Next thing I knew was some company named Peritus was asking my Mother for her banking information to get money out of her account every month to get her approved for the home that Brock said she was already approved for. I didn't like that or trust that so I asked for my Mom's money back from the deposit. Brock emails me and tells me we are bound by contract and I haven't heard from him again. I emailed Peritus and told them I don't need their services b'cos we're not getting the home and that I am waiting for our refund. I still haven't received it so I am going to write them a letter for it.

Looks like this company might be running again. I recieved this email today

Hello Everyone,

Some of you I know because I was in the middle of doing your loans and others I'm sure you're in a similiar situation where you gave deposits and now the company has closed down and no one has called or written to notify you. One of my borrowers, in Utah, is meeting with an attorney this Friday to discuss the situation and was told it would probably be more effective if a group of frauded buyers was involved.

I'd like to briefly tell you what I know and see if anyone can add anything they have found out. I was told all QWH and Goldbilt Homes employees were fired last Friday at a meeting, the sales people were told it was going to be a discussion on restructuring and moving forward. I was told they had a large some of money owed and couldn't afford to go forward. There was no discussion of returning deposits to customers. I have not been contacted by anyone with either company but I tracked down one sales person that gave me this info. A borrower of mine found out that Goldbilts company address was a PO Box in Billings Montana and I was told by others the same people were listed as owners on both websites.

Have any of you been contacted by anyone associated with QWH/Goldbilt? Do any of you know of other people this has happened to that are not on this email list?

My client that is seeing an attorney on Friday said she will call me after the meeting to tell me what she has learned and she would be happy to hear from anyone regarding going forward with litigation IF it seems like something can be done.

Consumer Fraud – Quality Wholesale Homes/Peritus Financial Services

I began looking online for a company that sold manufactured homes at a decent price. I found Quality Wholesale homes under the website www.qwhomes.com . I filled out the request for information and was contacted by the office within two days. I was given an access code to view the models and prices on the site. I was initially assigned to a sales rep by the last name of Rodriguez. I do not recall his first name. He seemed very unsure of himself and a bit unprofessional. After calling in a second time, I spoke with another rep named Rex Springer. Rex assured me that he has been doing this for over 20 years and knew his stuff. I asked to be reassigned to Rex.

I had several concerns/questions that I wanted clarified. The first being, would we be able to get a loan for both the land we were interested in and the house at the same time. Rex assured me that the financial group they worked with would be able to accommodate that request. I told Rex that we didn’t have a lot of money to put down and he again assured me that the finance group would be able to help us out. I told him that my credit wasn’t that great and he told me that they worked with a company called Peritus Financial who would do a credit mend for QW customers for FREE. I asked him what would happen if we couldn’t qualify for financing and he told me that he would make sure the purchase agreement was contingent on financing.

In the month of May, Quality Wholesale Homes ran a promotion. The promotion stated that anyone who signed a purchase agreement in the month of May would have the delivery and set-up fee waived. After deliberating with my sister, we decided that we should take advantage of this opportunity. I told Rex we would like to sign a purchase agreement and he scan/emailed the agreement to my email. I received the email on Friday afternoon and printed it out and took it home. It was a bit difficult to read, but I signed it anyway. My sister put the $2500 down payment on her credit card so we could “lock-in” the pricing and the promotion. We faxed the agreement in on Saturday May 30th, 2009.

The following week, I was handed over to Justin Kearns, Rex Springer’s “assistant.” After asking why I wasn’t dealing with Rex anymore, I was told that Rex is so busy that he has other people do the follow-up work for him once he has gotten the sale. I was sent additional forms regarding the specs of the house and I filled them out and sent them back the same day. Justin gave me the number of the finance company (Home and Land Finance) and I was assigned to a broker by the name of Ryan ____ . After speaking with Ryan and telling him our situation (we hadn’t purchased the land yet and wanted to do a single-close loan), he informed me that without at least 5% down, no one would even think of giving us a construction loan. I told him what our situation was and he told me that without additional money down, there was nothing he could do and he wouldn’t be moving forward on my case.

I called Justin back at this time and told him that we could no longer afford to go forward with the home. I asked him to refund the money we put down and the told me that that would be impossible since it is against the company’s policy. I told him that on the contract it read that we have three days to rescind the agreement without penalty and he just repeated that it wasn’t company policy to refund deposits. At this time, no services or products have been provided.

At the same time we put the money down, I was referred over to Peritus Financial Services to assist me in mending my credit. I was assigned to JT Maughan, whom I have yet to speak with personally. I was sent several forms to fill out. There was a form that listed the charges and an option to have the charges paid by QW Homes. I called Justin to confirm this and he said that the charges from Peritus would just be added to the cost of the home. I told him that Rex had told me that this service was FREE to QW Homes customers. He said he would check on it and get back to me.

As of July 16, 2009, I have left several messages, sent several emails and have yet to receive a single response from either of these companies. I got an email from Peritus listing an invoice of all the charges that would be “forwarded” to QW Homes for my credit repair, in the amount of $2, 200 ($100 per line item). On the credit report that I sent to them, I indicated a few potential errors and notated accounts that were old. They in turn filed disputes with every single one of my creditors.
After several attempts via email and phone, I began researching QW Homes’ business practices. It turns out that I am not the only person who had this exact same situation happen to them. Several other consumers have posted even larger down payments and are out thousands of dollars. It seems that this company (DSH Housing) has several negative complaints filed against them with the Better Business Bureau, and instead of changing their practices, they change their name. I went on their website this morning and there is not even so much as a number on there now. It simply reads “Under Construction.”

Change of Name
have found out that the owner of Goldbilt homes is Devon Howards (he owned Quality WholesaleHOmes) son. and he has taken the salesman from Quality to Goldbilt. So it should be no surprise to those of us that have lost money that Quality and Goldbilt site have the same offers on them.The internet site for both are registered to the same person.They keep changing the site for Goldbilt as people find out and post what they have found. I just wonder just how long before the BBB in Mt starts getting complaints.

I feel like I've just been raped. I thought I was getting my dream home, but what I got was scammed. In 2005 I owned my current home free and clear. I was talked into getting a loan on it. I was taken then for the sum of 20, 000.00 It was by someone I considered a friend. I was put in a two year balloon payment which I couldn't pay. I was told I would have all my debts paid off, and would be able to refinance. It didn't happen. Then on September 4th 2007 my oldest son was in a fatal car accident. I was told that I had a new loan to refinance my home. While my son lay in the hospital fighting for his life (which he lost), I was told I needed to replace my roof, and they would fund the loan. I was suppose to close on Sept. 18th, it took me a couple weeks to realize we didn't close. I called the finance company and was told the woman I was working with had quit working there, and I was left out in the cold, and out my home. I managed to talk the people who financed my house into an extention for another two years. It's almost up. So, when I got the e-mail from Quaility Wholsale Homes, and pre-qualified for my loan for a new home I was the happiest I'd been since my son's death. I was going to be able to put his 3 year old daughter into a nice home to be raised in. I related all of this information to Brock Henning when he told me I had quailified for a new home.

I was then told that If I wanted my home delivered free of charge saving me 11, 000.00 dollars I had to send 1, 000.00 by July 1st, 2009. I didn't have the money to send. I was telling my son of 22 years of age how I needed to try to come up with the 1, 000.00 saving me 11, 000.00 for delivery of my new home. When his wife found out I needed the money she opted to do whatever she needed to to get me the 1, 000.00 for the free delivery. She was soo exited for me. They ended up pawning all of their firearms to get me the 1, 000.00 t0 send to Brock.

Needless to say. I had to call them today (July 9, 2009), to tell them that I had been scammed yet again on a home. A roof over my three children's heads. I cried all day long, and seriously felt like I had just been raped. My dignity, my pride, my sense of self worth all went down the drain, as I realized I had been taken for 1, 000.00 dollars, plus a roof over my children's heads. I feel really stupid right now, and that's hard for a woman whom everyone considers very intelligent. This is no better then foreigners scamming citizens of the United States by all their scams. I really thought I was too smart to be scammed again on a home. The harsh reality being I just wasn't. I will gladly be a part of anyone or anything, or any court case, making these people pay for what they've done to me and my children. Count me in!!! I will not be happy until these people are behind bars, and all their victims compensated. I do have legal experience and family in our Criminal Investigation department in which I will be contacting tomorrow to see what can be done.
