EMPLOYMENT
I am 27year old female resident of Punjab, Jalandhar state that:-

I have been selected as a Radio Presenter and Newscaster in Radio XL T/A Central Air Radio Ltd in Birmingham, United Kingdom under the employer Dr. Arun Bajaj, Radio XL, 191-194 Bradford Street, KMS House, Birmingham B12 0JD (Managing Director).

At the time of my appointment I have signed a contract of two years for £15, 000 p.a., £200 living expenses and rent per month.

On this basis, my work permit for 2 years was issued from Border and Immigration Agency in August 2005.

Before interview I was told by Dr. Arun Bajaj that I need not to pay for all the Visa fees but after reaching Birmingham he started demanding all the fees for processing through his solicitor Mr. Harjap Bhangal. For this processing he kept pending our salary for few months.

Then in November 2007, he started asking me about extending my work permit and stay in the country. But he delayed the things willingly and sent the paperwork for extension to Border and Immigration Agency through his immigration solicitor to extend the work permit after signing the contract for another 2 years.

On 22nd February 2008, Dr. Arun Bajaj handed me a letter for a disciplinary hearing for the termination of my services. At the same time I have shown him e-mail from Mr Harjap Bhangal that I am entitled to work in United Kingdom under my current work permit.

On 25th February 2008, I attended the hearing with Dr. Arun Bajaj in the presence of Mr. Sukhjinder Ghataore, Mrs. Sangeeta Bajaj and Vijaydeep Marwaha as my work colleague where I have shown him e-mail from Mr. Harjap Bhangal dated 25th February 2008.

On 27th February 2008, Dr. Arun Bajaj handed me termination letter in which he has given me the right to appeal.

On 5th March 2008 I appealed against his decision through an e-mail.

Letter received from Dr. Arun Bajaj on 5th March 2008, mentioning that my appeal has been taken as a grievance and there will be
a grievance hearing on 7th March 2008.

I attended grievance hearing on 7th March 2008 taken by Mr. Sukhjinder Ghataore, a senior employee of the organization.

Received letter from Mr. Sukhjinder Ghataore dated 6th June 2008 regarding outcome of appeal hearing.

I filed a case in the Employment Tribunal through my representative Mr. Adris Mohammed, 6 Tiverton Drive, West Bromwich, West Midlands, B71 1DA against my employer for unfair dismissal and outstanding wages.

After filing a case I received a letter from Dr. Arun Bajaj’s representative; Davies and Partners Solicitors for the offer of out of the court settlement.

At the same time I received the letter from Employment Tribunal dated 24th July 2008 for Case Management Discussion on 7th August 2008.

I attended the Case Management Discussion (CMD) in which full hearing date was allotted to the case. After that representative of Dr. Arun Bajaj contacted my representative to come and sit for out of court settlement and on 26th September 2008 we received an agreement of settlement of £13, 000 through my representative which was sent by ACAS.

After waiting for more than a month; when I did not received any payment, I finally decided to come back to my home country after discussing this with my representative as he assured me that he will be filing case ahead in County Court on my behalf as he has not paid me according to the agreement of settlement to end up the case (It was also suggested by my case worker Jane Adams in ACAS to go to the County Court).

After I came back to India, Mr. Adris Mohammed (my representative) asked me for £250 for hiring solicitors to file a case in county court. The case was thoroughly settled between us through a written agreement but after long, long wait i.e. more than 1 year Dr. Arun Bajaj did not give any settled amount to me.

According to my settlement agreement, I requested the employer to pay the amount to Mr. Adris Mohammed, my representative. Now almost 2 years had past, nor Dr. Arun Bajaj or my representative has sent a single penny to me. I do not know if my employer gave the money to Mr. Adris or not. Mr. Adris never replies to emails sent by us, the only reply I got from him was that I will let you know all the details that what’s happening with the case this weekend or the other but this habit is going on from last so many months and we have been not informed anything related my case.

If Dr. Arun Bajaj did not make the payment then he should be punished and asked to send money immediately.

So I request your goodself please enquire the case and give me the justice which is pending from long long time.

I wanted that you should know that what wrong the residents of United Kingdom do, by calling people like us from countries abroad and use them as if they are not human being.

I will wait for your reply eagerly.
