Fed Up with Raintree Vacation Club

Fraud, Extortion
Never buy a timeshare from Raintree Vacation Club. We were scammed by them during the sales presentation through lies, half-truths, innuendo, and the withholding of key information. We were told by the sales rep (scam artist) that maintennace fees could not, by law, increase more than 2-3% per year. Last year, Raintree jacked theirannual fee by 25%! They also imposed a Special Assessment of $880. on everyone, probably because the recession has led to fewer new sales. There is no mention of special assessments in the contract and the salesman never mentioned them. When we were late in paying this year's annual fee (25% higher than last years), we were subjected to threatening letters from their agent, RCI Contact Solutions. They are imposing a 10.5% penalty PER MONTH on us! That's 126% interest per year! Federal law states that enything over 24% is usuary. These extortionists are five times over the Federal limit! I urge you to write the Justice Department (the U. S. Attorney General) if you too have been scammed or threatened by these people. I am!

disappearing developer weeks
We just got back from Cabo Sn Lucas, bought into the RVC concept. We were promised 7 developer weeks with rent of $1, 400 per week, to be paid within 60 days of when we turned them over to the marketing company, Premier Property Management. I was given guarantees that when we got back and made the call, we would see $9800 within 60 days. Now they want $499 to activate, and say we had to have the weeks to them by September 2010. Now they don't know when we could see the rent. Turns out the guy who works PPM also answered the phone for Resort Equity Solutions, the company that was to take our whole ownership week in trade. He too wanted another $500. And no contracts have come. Now I am getting hangups at these two entities and no one returns calls at RVC or emails.This was all on our AMEX card and has been put in dispute. Need help going after these crooks.

Special Assessment
The special assessment is ridiculous with the economy they way it is. Members should have been able to vote on this issue, rather than having it shoved down our throats.

Maintenance Fees
We have owned our Timeshare, purchased from Club Regina (Mexico) in 1995 for 15 years. The Reguar Maintenance fees have escalated greatly over the last 15 years. And, especially, since Club Regina was incorporated into Raintree Vacation Club. This year the regular Maintenance Fee was $846.00...AND... another additional "special maintenance fee" of $846.00 was also assessed. In all $1.692.00 in fees for this year (2009). In addition, we cannot go to any resorts other than Cancun, Puerto Vallarta & Cabo. They threaten to ruin our credit if we do not "ante up" the total fees. What can we do to fight these people? We are 69 and 70 years old and Mexico is no longer our vacation of choice. So, we put our time into RCI (another fee for one year $89.00). And then, another $194.00 to book a vacation. I think we could have had a decent cruise ticket for the $1, 975.00 it cost us this year. Linda Cormier, Menifee CA

special assessment
We have been owners of the Club Regina Cancun for 10 years. It was then bought out by Raintree. They asked us for more money to join the club and we said no so we continue to use Club Regina resorts. In July of 2009 the special assessment came out to do many upgrades in multiple resorts and we have been asked to pay for this. This is nowhere in our contract. We do not want to pay this.
We are to pay maintenance fees only, which by the way have gone up tremendously from $500 for a 2 bedroom to $900. or more! The maintenance fees should be covering these upgrades! Mrs. Nolan from NJ

2nd Request for Special Assesment
I just got the revised letter for the special assesment from RVC at the end of November. In the cover letter, there is mention of a Member Advisory Committee. Does anyone know where a list of these members might be located or how they were chosen - or if there truly is a committee? I was told I cannot access the RVC "members only" section because I have a B-share ownership. Is there a way to contact this "members committee"? I have a few comments/suggestions!
Also, B-Share members rules and regs section 1.2.3 has no wording indicating that special assesments may be charged. The wording doesn't even include the term "maintenance fee". It just says fees for use/upkeep of units.
I have never had problems with reservations or being "lied to" like a lot of the other postings. My vacations have always been great, but being charged a double maintenace fee in one year is a real hardship. The extra charge is what I would spend in airfare. It takes the amount I spend for a one week vacation well over the cost of an all inclusive package - in some cases 2 packages to the same resort towns!
If you pay the regular maintenance fee but not the special assesment, what are the consequences?
Any help will be greatly appreciated!

Special Assessment
Ireceived a special assessement for $666.00 in June to be paid starting in July. I have owned at Club Regina, Puert Vallarta, Mexico for about 16 years and own outright. In that time my maintenance fees have gone up almost 40%. I was told at time of purchase by Mr. Jose Noe that the maintenace fees covered all maintenance and upgrades. I owned timeshares elsewhere and this has always been the case except for one in Florida that was hit by a hurricane and a small special assessment was made of everyone to repair some hurricane damage. That was reasonable. The have sent me 2 notices. I e-mailed them and faxed them agreeing to have the money come from my checking account on a monthly basis for 6 months. I have not heard back from them, but to remind me I have to pay this assessment beginning July 15th (today). There is no phone number to call nor is there a person to talk to. What have they done with the information I have already sent twice to them? The assessment makes me seriously wonder if they are meeting their fiduciary responsibilities to their members. WHERE ARE ALL THE MAINTENANCE MONIES GOING OVER THE YEARS AND HOW ARE THEY BEING SPENT AND ON WHAT. WHO OVERSEES ALL THIS? I am very suspicious and disgusted with Raintree. When I purchased my condo Raintree was not involved, only RCI and the Westin Corp. Since Raintree came in I have been treated like an unwanted stepchild since I did not buy from them and do not have full Raintree priveledges. This is disgusting! They say I do not have enough points!!! My original contract was not based on points, but weeks. They changed the rules and left me like a dog begging for scraps and now they want more money. I'm disgusted with them. Only thing is...I like my condo.

Special Assessment
We have been members of RVC/Club Regina Los Cabos since 2002. Our membership is silver, studio, every-other-year even. My experiences have been pretty good until now. Like others posting on this site, our maintenance fees have almost doubled since we started and I too am distressed about lack of forthcoming information from the leadership of this company. No accounting of where our money has gone and now assessing a special fee for items that we were told would be covered by our maintenance fees. I have not yet reread our contract, but I am sure it is like most everyone else's - no reference in any way to special assessments. Since we are not due to use our timeshare again until 2010, we will likely hold on to the assessment to see if anything happens from a legal perspective.
If Los Cabos is sold out (as I have seen on other posts), maybe now is the time to sell...
Is there anyone who is coordinating or organizing RVC timeshare owners on this issue? Please advise.

Are we all in agreement that Raintree is out of line with this special assessment fee being charged and due July 15th?? Have you written to the Texas State Attorney General about this nonsense?
Are you in agreement, that since this property is in Mexico, we are NOT owners but Right To Use Members or renters?

special assessment fee for every other year memebership
I'm agreement with everyone about unfair assessment charge. What's more infuriating is that I have a Gold even year membership and Raintree is charging me a full assessment fee $820 for a half year membership. When I called Raintree and asked about the full assessment fee for a half year membership, they said I have to pay the full assessment and I’m being compensated by matching me up with 100, 000 Raintree vacation Club points. This means I have to use my limited 40, 000 points to get an additional 40, 000 points through RCI. I told the representative that I’m not interested in the points and I should not be charged a full assessment fee for a half membership or any assessment fee for that matter. The representative told me to call Sharon Racine (713-290-2833) in their corporate office that will be able to help. I called her and I got the same response as many of the other people who called; a voice mail and no return call.
