On August 11th 2008, we entered into a contract with Don Wilmore Jr. DBA Remodeling Express for remodeling job. The scope of work was to enclose a second story patio and make it into a bedroom.
The total cost of the job was agreed upon to be $19, 000. Don Wilmore Jr. requested $7, 000 at contract signing. On August 11th, 2008 the contract was signed and the check was given to (and cashed by) Don Wilmore Jr..
The work did not begin on the project and we called Don Wilmore Jr. to find out what the status of the project was on August 15th, 2008, his phone number was not in service. We did not hear from Don Wilmore Jr. until we again tried to call him on August 19th, when the phone returned to service.
Don Wilmore Jr. was unable to get a permit to do the work from the City of Sugar Land. He informed us he would not be doing the work, but would repay us. During the remainder of 2008 I frequently called Don Wilmore Jr. to arrange repayment but was continually put off and only repaid $100.
An architect was hired by Don Wilmore Jr. to complete the drawings and permits($2092.50).
At the start of 2009, I attempted to set up a payment plan for Don Wilmore Jr. to make the repayment. On February 16th, 2009 Don Wilmore Jr. repaid $1000. After that time no additional payments were made. Don Wilmore Jr. has also not agreed to have a meeting after that day.
Don Wilmore Jr. expressed a desire to repay the debt, and on this basis he was afforded additional time, but he has become unresponsive and shows no intent to repay the debt.
Don Wilmore Jr. still owes us $3807.50 ($7, 000 - 100 - 1000 - 2092.50)
