Saxon Mortgage Number 12105093 Fraud loan
My name is Tracy Wood I found myself in a position where I needed to modify my loan in 2008’.
I had signed up for the loan modification program in July 09 and at that time Saxon gave me a modified trial payment of 2971.00 and from that month forward I faithfully maintained that payment which I have documentation to support that no due date was established this was prior to Saxon asking me for any documentation for loan re approval.
In August of 09’ I got a postcard in the mail saying that we have been trying to reach you because we are missing some documents. This was the first communication regarding documents before this time they asked for nothing. I sent in the information they required in August which they promptly lost and I found that out in September so I resubmitted immediately.
Finally in May of 2010 I received notification that I was approved for the loan modification and that documents would be sent forthwith in June.
Months past no documents every month I called and they consistently told me that they were sent and that I should have them which obviously were not the case. They should have come in August of 2010 and but they never arrived. Throughout this process I continued to make my trial payment.
In October of 2010 I really was aggressively trying to get to the bottom of what was going on with my loan. I spoke to numerous people that I have documented each of their names and times that I called and wrote down the conversations for later use.
In December 2010 from I received an email from realty trac which is a foreclosure site I subscribe to that my home was on the auction block with no date. I immediately got on the phone and talked to Bridgett at 930 am she told me and I quote that you are approved as of June 14th 2010 doc’s have not been mailed but will be right away. She also reassured me that there was no sale date and my home was not in foreclosure.
On January 3rd my HOA sent me a letter informing me that Saxon notified them that my home was in foreclosure and going to auction and letting me know that I owed them money. Which prompted me to make a phone call to Saxon and I spoke with Sarah. She gave me the same song and dance as Bridget and reassured me again of no auction or foreclosure. She put in a work order to expedite my loan modification documents.
On January 28th I received another notification that my house is up for auction from realty trac which again required me to make another call to Saxon to find out what they are up to. I talked to Angie at 921am and she said your house is not up for Auction and is not in foreclosure you are still approved for the program but you have not received loan doc’s because of a discrepancy on the payment date of July 1, 2010 and the loan doc’s said first payment due August 1st 2010. She told me that they had to go back to underwriting to fix the doc’s. I asked Angie a question about what I had been hearing second hand that Saxon was selling homes out from under homeowners that were in the loan modification program. She said and I quote “that is completely false and Saxon would never do anything of the kind”. Before I was able to complete call we got disconnected and waited for 20 minutes to call me back. I then called Saxon back and got Robert who proceeded to tell me that this is a call center and there is no way to get back with Angie and that was it.
The next day I left for vacation and I was gone till February 7th. When I arrived home there was mail in the mailbox, boxes on the porch, nothing out of the ordinary. The next day I get up expecting too caught up instead I receive a phone call at 8am from an investor who was planning to buy my house at auction at 11 am this morning. He told me that I should call Saxon ASAP that this is a new trend in lending. I get on the phone with Mr. Wilbern and he proceeds to tell me that I was denied January 28th 2011 the same day I spoke with Angie and he could not give me any explanation for the denial. I then asked to be transferred to a supervisor and then 20 minutes later I spoke to Ivan the supervisor ID#20935 and he went through the file and he told me that I was missing several payments which was not true and I called him out on it and he found the lost payments. Again I got nowhere with this individual he could not come up with any bonefide reason for my denial. He told me that Mary Castio denied my without cause. Then I called back and got Rachel on the advice of my lawyer and he advised me to ask for a 30 day extension on the sale. Rachel responded to the request by saying it is 1055 and it will take me 5 minutes to get my supervisor so she said it was a lost cause.
At 1230 the house sold for $292k my question is why did they string me along cost me 47, 536 and not give me an opportunity to get a loan with another company for that amount because if I could not qualify my boyfriend easily could which is what we are doing currently but at a higher amount from the investor that bought my property. Bottom line I received no notice of the sale of ANY KIND no denial letter either it is like with live in a 3rd world country and we have no rights the last time I checked I thought we lived in America. I have propaganda from Saxon which I would love to share with you that clearly states that I was approved for modification.
Since this happened to me I have done research on this company and the have 739 complaints through the BBB and a D- rating. The complaints are similar to what I experienced except that they were notified of the pending sale and I never was!!!
