Defective Mattress
We were sold on 2/15/09 what we believed was a new King size Sealy Back Saver Peach Springs Mattress Set. Sale handled entirely by store manager Lawrence Gibson. Delivery was arranged and promptly completed. Upon delivery nothing unusual found. Within 1 week ridge started forming in center of mattress and one side of mattress started sagging and slanting away from the center of the mattress and become more pronounced as the days went on. Immediately contacted Lawrence and he acted shocked this problem started to develop so quickly. He then stated we needed to file a warranty claim. Now before we paid him our hard earned money we asked how they handled any problems with the mattress and his reply was we come out and replace it no questions asked. Now all of a sudden there is a warranty claim we had to file and this required an inspection from the "independent third party" Mattress Marshals. Trusted Lawrence to do the right thing only to find he was less than honest with us. While in the store submitting the claim form Lawrence states they have had a lot of claims submitted on this mattress he just sold us...where was this minor detail before he took our money?Anyway instead of the 48 hours Lawrence told us it would take before we were contacted by Mattress Marshals it took 10 days to finally receive a call. First appointment inspector called to say our appointment was given to another customer! Finally they showed up a month later to do the "inspection". He stated they used stat-of-the-art tools to measure (2 bull paper clips and a piece of string!). Was here about 20-30 min. After he was done he would not give me any info about his "inspection", just stated we would get a letter in a couple of days and if we did not like the outcome we could have them come back out in 6 months!. He also neglected to say we would have to pay $50 for them to come back. And to noone's surprise we get a letter a few days later denying the claim stating "No warrantable defects found". We immediately called Lawrence and he asked we allow him some time to make it right. A week goes by and not a word from Lawrence so my wife calls him and he claims he was not getting any resolution from his Sealy contact person. We asked for the name and phone# of the Sealy rep and after some arduos bickering he finally gave us the contact info. My wife called the Sealy rep and she stated she could not find this mattress model in their system but stated it could be a mattress made for Mattress Warehouse specificaly but also went on to say Mattress Warehouse had been advised about making false claims about the performance of their memory foam mattresses. Sealy rep said we should try and work out problem with Mattress Warehouse so we again waited for Lawrence to remedy the situation but to date we have not heard from Lawrence or the Mattress Warehouse. We then received from Sealy a warrany claim form to fill out, which we did and faxed it back to Sealy on 6/14/09 and to date we also have heard nothing more from Sealy.
