True and Accurate Story about Matt Smurr/Smurr, Inc.
My name is Tracy Stein-owner of said property in which Mr. Smurr/Smurr, Inc. were contracted to work on various projects/improvements on our property. Mr. Smurr/Smurr, Inc. responded on this website and made some false and inaccurate statements about events regarding our project. On Wednesday, January 30, 2008 walked off our job site and refused to return our many emails, phone calls, voicemails, and faxes. We were informed by several General Contractors/Subcontractors that the work that Mr. Smurr/Smurr, Inc. conducted on our property was not in accordance with commercial/professional standards and would have resulted in a fire hazzarad and not passed inspection we had the legal right to discontinue his services. Subsequently on Feb. 7, 2008, we filed suit against Mr. Smurr/Smurr, Inc. for breach of contract, failure to perform, failure to complete work, conducted substandard, deficient, and commercially unacceptable work, failure to pay subcontractors, and etc.(Case No. 2008-CA-002581-0 Orange County 9th Circuit Court).
Additionally, we filed a complaint with the State of Florida Department of Buiness Professional Regulations, and the DBPR has started an investigation against Mr. Smurr/Smurr, Inc.
We never refused to pay Mr. Smurr/Smurr, Inc. for any services. Mr. Smurr/Smurr, Inc. failed/refused to provide us with invoices of extra or any worked conducted on our project. We have sufficient documents to support that we asked for documentation.
Prior to Mr. Smurr/Smurr, Inc. we never had a situation where a general contractor or subcontractor walked off the job, used inappropriate materials or conducted substandard work.failed to perform or breach the contract.
Mr. Smurr/Smurr, Inc. did put a lien against our property;however, the courts will determine this lien to be invalid/possibly fraudulent.
We want Mr. Smurr/Smurr, Inc. to reimburse us in the amount of $31, 500 (+)plus all legal expenses to bring the complaint against him and defend our self against multiple liens by subcontractors. Please note Mr. Smurr/Smurr, Inc. informed many subcontractors to put liens against our property, fortunately all liens have been dropped by subcontractors because they were classified as invalid.
