I fell for this scam in November of 2009, called South Beach Brite (and ALL affiliated memberships they signed me up for) at least 10-12 times, aquired an RMA #, confirmed cancellation of memberships, and obtained a tracking number for shipping the product back (all within the 14 day trial period). Recently I received a collections letter signed by South Beach Brite for $128.95 (I also had cancelled my debit card through my bank back in Nov.), being collected by Apex Solutions, LLC at 7251 W. Lake Mead Blvd, Suite 300, Las Vegas NV, 89128, phone #866-728-1467. For anyone else in a similar situation, I would advise you read what my investigation has uncovered before you pay anything to this "collections department".
First, I couldn't locate South Beach Brite anywhere - not on the net using a reverse address/phone look-up, through directory assistance (1411), or from dialing the number that I did have (recorded greeting states "thank you for calling the corporate office"). I called Oscar at the corporate office from another post on this website - he had absolutely no record of my RMA or tracking number, prior phone calls, and frankly was perhaps the most argumentative, rude person I've dealt with. His official title is "Training/Administrative". My contact got me nowhere other than his suggestion to pay the $128.95. He even stated that I never called anyone!
Next I tried to find Apex Solutions in Las Vegas. Reverse address look-up found 40 companies in the same suite 300, none of which were Apex. Directory assistance and web search also found no reference. I called my state Attourney General's office, and found that collection agencies must be registered in my state - and this company was not (the attourney found Apex - a technnology company dealing with computer software intergration, at a different address.
Then I called Apex at 1-866-728-1467. First call = "Billing department, may I have your first and last name please" - I asked the name of the company and the lady pretended she couldn't hear me all of a sudden (even though on the call I tried two different hand sets and the speaker phone, and tested it on a call right after that with no proplems) and hung up on me. Call number 2 I asked the different lady to repeat herself (verifying that she could hear me), which she did. When asked for the company name she just hung up on me. Call number three - got Bobby, verified he could hear me, then asked for the street address where I could send legal documents (as a consumer according to the Fair Debt Collection Practices Act, you have the right to request the name and address of the company claiming the owed debt, and state that you're disputing the debt). He gave me the address on the letter - and when I stated I couldn't locate the company, he said they're really very new, took over the debt from South Beach Brite as well as many other companies. When I said they're not registered in my state, he said he was suprised as they've been around for a long, long time. When I asked him for the address for South Beach Brite (which he said I'd have to contact about all of this), he said he couldn't get that since he's not allowed to leave his cubicle. He gave me the 954-237-2690 number, and as we all know that number says "thank you for calling the corporate office - please leave a message" for which you never receive a call back.
Long story short - I can't locate/validate South Beach Brite, Apex Solutions LLC, and can't mail my dispute letter as the companies "don't exist". My lawyer has advised that I file a complaint with my state attourney general's office (which I have), and dispute the credit report fillings if one appears from Apex. Oh - and I keep getting calls from "Provo, UT" at 801-229-2252, a disconnected number. Qwest says companies can enter any name and any number in their dialing software - so you don't know who is calling, can't call back, and the call can't be blocked. Tell me these companies with their 20+ names are legitimate. Anyway, if you receive the same collections letter - you may want to think twice before you call the number on the letter and provide a credit card number.
