refusal to release a vehicle to charge extra days in the yard
I had a motorcycle accident on Friday. I was taken to the hospital right away, and my vehicle was towed to a yard. Today Saturday, still being hurt, I decided to pick up my motorcycle, so I started calling to the tow company info. given to me by the CHP. However, nobody answered, so I decided to go straight to the yard. When I got to the place, big surprise!, they had moved to a different location without notifying the CHP. Fortunately, a neighbor gave us the new telephone number of the towing company. Then, I called the new number, got the new address, the person who answered said that they were closed, but paying (an exaggerated) $100 gate fee he would go to the yard and release the motorcycle. But, he said it would take him one hour or two to get there because he was with the CHP taking care an accident, (they don't receive calls to help with accidents that far from where their yard is located, I assume he was lying) all an all I accepted. He made us wait there for two hours and never arrived. After that two hours I called several times and he hanged up on me. After several calls, he finally answered and talked to me, and he told us that it was going to take him an extra hour to get there, so i waited an hour more. At the end, he didn't arrive nor answered my calls any more. I left with out my bike and had to pay $180 to the tow truck driver i went to pick up my bike with. Oh! and while I was waiting outside of the yard, I saw a huge sign saying that the gate fee was $80 not $100.
