would not give deposit back and did not come threw with move in date
I looked at a property threw this management company and really liked the apartment. They said it was a $30 credit check fee and they would only accept cash for this. That sounded a little strange to me but I really wanted the apartment. Then I think it was about a few days later Cathy from SPM called me and said that I could have the apartment. I asked her when I could stop by and go over the lease with her and she said that I just needed to drop off a deposit of $500 in money order form. I asked her when would be a good time to stop by and sign the lease and drop off the deposit. She said I could stop by any time. I let her know that I wanted to move in that Sunday Oct 18th. She said that would be great. I called her Wednesday morning Oct 14th and she was about to go into a meeting. I asked when I could sit down with her and go over the lease. She said I could stop by later that morning. I stopped by and she was still in the meeting. She briefly talked to me and said she would call me when she was done with the meeting. I gave her a deposit of $950. She never called me back that day. I called her on Thursday and asked her again when she had time to go over the lease with me. She said, "Oh we'll just take care of it the day you move in." I thought that sounded strange. Then she asked me what day I wanted to move in. So I told her again that I wanted to move in that Sunday and I wanted to be there early. She then told me that they couldn't have anyone out there on Sunday and could I move in on Monday. I said well this Sunday is really the only day that I have time to move. I told her that I didn't understand why no one would be available on Sunday. She said they just didn't have anyone for that Sunday. So I asked her if I could come by sometime that Friday and sign the lease and get the keys but have it start on Sunday. She said they couldn't do that and the day I sign the lease is the day the rent has to start. That sounded very strange to me. So then she talked me into moving in on Monday Oct 19th. I said ok then can we meet there at 9am. Then she said well 10:30 would work better. I said ok can we compromise and meet at 10am. She said ok. I was there Monday at 10 and she was not. At this point I felt like that is it. I don't want to deal with a management company like this. She called me at 11am that day and asked, "What day was it you wanted to move in?" I said, "Yesterday!" Then she said, "that was a year lease right?" I said, "No, it was for six months. To be honest, at this point I feel really uncomfortable renting a place from this company." She said she was really sorry and the reason that I couldn't move in on Sunday was because she was waiting for someone else at her company to write up the lease. Now this really sounded stupid because this is a property management company. They should have standard lease forms that you fill out. She begged me to give her another chance and I said I don't know. At this point I would need a contract that would guarantee me that if anything broke at would be fixed right away and also a guarantee that when I move out I will get my deposit back. She assured me that they had a very good and prompt maintenance crew. I said that I would need it in writing. She begged me to give it a few days and think about it. I said ok but at this point I really don't feel comfortable doing business with this company and I will have to get my deposit back. That week I tried to get a hold of Cathy a few more times. Each time I got put threw to her voicemail and never got a call back. So finally on Monday October 26th I called the office and was told that Cathy was not there so I said I just needed to talk to someone. I was put threw to Andrew. I told him that I did not want the apartment at this point and needed to get my deposit back. I told him the reasons why and he said that was unfortunate and that they really wanted to work something out with me. I told him that I had already gone and looked at a couple of other properties and was just waiting to hear back from them. He asked me if I would just give it a few days and think about it. I said ok but I really don't think at this point that I feel comfortable renting from this management company and that I was going to need my deposit back. I called the office again later that week and talked to Andrew and told him that I was defiantly not going to take the place and I needed to get my deposit back. He then said he would have to get back to me. I then came back into the office on I think it was either November second or November third. When I came into the office they said they would mail it to me. I thought that was strange since they already knew that I was coming for my deposit and how hard is it to write a check. I never received anything in the mail and I called a couple times and talked to Andrew and he said he would call me back and never did. I finally had time to go to their office on Monday November 16th to get my deposit back. Andrew said that they were not going to give it back to me and felt like they didn't have to give it back. He finally said he would give me half of it back only if I signed a waiver saying that I would forfeit the rest of the deposit. I told him that that was unacceptable. So now I'm going to have to borrow money so I can pay for my rent this month and file a lawsuit against them. I know I will win because they have no grounds to keep my money. I'm really tiered of these management companies that screw people out of their deposits and over charge on credit checks. I would like this company investigated on their practices because I believe that they are dishonest. What they did to me is unacceptable.
