Over the last 30 years, I've purchased 4 homes-and have never missed a payment until now--NOT DUE TO ANYTHING I DID OR DIDN'T DO. READ ON: AND BEWARE: Due to a tax reporting error, SM drafted $400 more than my mortgage payment should be. This action sent my account, payments, etc. into a tailspin--ping ponging every which way--fees mounted. I disputed the amount which was eventually refunded to me, after my bank disputed the amount of their draft. But by the next month, due to all fees incurred, I had not the money in the account to make my payment. By the third month, I had enough to pay one month, but they refused one month. All the while they knew this was not my fault. I had not been properly notified that such a drastic change was to take place. Now, they are threatening foreclosure. As I am handicapped and on a fixed income, I have not the ability to generate additional income. Admittedly, this mortgage has been a struggle. I've dealt with SM in a calm aand civil manner. My suggestion to them at this point is that I sell my home, they get their money and I purchase a smaller home. with their financing. CAN'T DO IT! WHY? MY CREDIT IS RUINED BECAUSE I FAILED TO MAKE MORTGAGE PAYMENTS. i GUESS they assume everyone has an extra $400 in their checking account they can rip them off. I was actually scolded by one man because i "failed to make the payments." It took several minutes before I convinced him to look further back--I gave him dates. He justified their actions by saying they sent something in the mail to me prior---the mail? That piece of mail elluded my mailbox. Having refunded the money, it seems they are admitting wrong doing. My suggested resolution contained much sacrifice on my part==including the expense, stress, loss of close neighbors, my support system.
MY QUESTION, if anyone has an answer, is can STANDARD MORTGAGE be held liable for the damanges done to me.? What kind of attorney do I seek? Please advise.
