Bias, failure to take my claim seriously
We got into a car accident in Baltimore, Maryland. We were completely stopped for over 20 seconds, waiting for opposite direction cars to pass, trying to make a turn into a Walgreens parking lot when Car B, hit our car, Car A, in the driver's side door. The driver of Car B admitted that he was trying to make a call on his cell phone and wasn't looking up at the scene of the accident. He was travelling behind us and failed to stop, or go around us. We both have Statefarm auto insurance. The accident took place on Saturday 9/18 at 2:45 pm. Police arrived at then scene and did not file a police report. We filed a claim with statefarm at approximately 3:30, and so did the driver of car B. At approximately 5 pm (all offices were closed and only phone operaters were at the offices) we received a call saying that they denied our claim against driver B, without receiving evidence or official statements. Statefarm changed the story 4 times, first saying that we cut across 2 lanes of traffic to get turn, then after they saw the evidence that it was a one lane street, they claimed that Car A blew a stop sign. After I showed them pictures of the scene of the accident showing no stop sign, they said that we blew a yeild sign. They never went to visit the scene of the accident, and only looked at a picture from google earth. After we denied doing anything wrong and showed no yeild sign near the scene, they again said that we made a turn from the right lane rather than the left lane. It is clear that it was driver B's fault, and they are showing him preferential treatment for whatever reason. We submitted approximately 10 pictures and have video evidence that there is only one lane in the street, and they are refusing to accept the claim when we are 100% sure that driver B was at fault. We are from New York, and if the accident took place in New York there would have been a police report describing exactly what happened, but since the Baltimore, Maryland police failed to file a report, there is no official evidence against us, nor driver B. Statefarm is not doing enough to fight for our claim, and are only fighting for driver B's claim against us. Car B was driving behind car A (ours) and hit us over 20 seconds after we were stopped waiting to make our turn. We want to file an official complaint against all agents involved with this claim, and against the driver of car B, for lying about the accident, and fraud. If and when they finally find fault in driver B, then we would like to file a legal suit for fraud on their part, bias, and for all the stress, agrevation and time that was spent on it
