GoKart - Lawsuit Filed and WON! Oct 2010
Update on the Small Claims Lawsuit filed against Sunny Sports Inc, aka...New Star Marketing, Scooter Depot...with Amy Barnes, Mr. Lei (Lie) Lu, Mary Lee, Ivy...and other cast of members. I have enclosed the final WON small claims lawsuit against this dishonest company in Elizabethtown, KY. You can follow the past history on this major legal event that ultimately was against them! I reversed my misrepresented GoKart charges (using my VISA) within a couple of days, I sent them a letter charging them $30.00 PER DAY for storage fees of their GoKart in my garage (notified them via Certified Letter), they did not show up for court TWICE, they lied to the judge via an unsigned letter, finally won judgement against them for $1, 167.00 for STORAGE FEES (not for the Gokart charge - already got that back before), the Judge put a clause legally disolving their impossible/ridiculous return policy of 30% (got $30.00 per day storage charge since THEY like the number "30%" :) ), and finally they had 30 days to pick up their GoKart and failed. Notified them in writing about the abandoned GoKart AND restarted ANOTHER $30.00 per day storage fees...they abandoned it!! What did I finally get after this??? :) Kept the GoKart, got my $1167.00 from my VISA, and Sunny Sports Inc sent me a check for $1167.00 for storage to include 2 payments of $94.00 for court costs!! Yes, they can be sued and they MUST appear in your local Small Claims Court due to doing business once your "product" arrives in your city/county!! They DO NOT have any attorneys...do not feel threatened and call their bluff!! I hope this helps other honest consumers stay away from this company or at least file a Small Claims Lawsuit and VISA ChargeBack immediately!!! Send them a registered letter stating you are also charging them $30.00 per day for storage from the day you received their product for you taking care of their defective/misrepresented product.
