For a breach of contract case, and what I think smells of bad faith, I persued and won two judgements against this company for the refund, plus expenses.
In each small claims round, this company has ignored the court rulings and are currently held in contempt of court. Despite an active Capias which I might yet exercise, company continues to refuse to do the right thing and pay / close their court order, under $450; yet they aggressively advertise their million dollar expansions throughout the media.
The Better Business Bureau notes that his company has an unsatisfactory record due to unanswered complaints and a pattern of complaints. Among the 466 peers in Eastern Massachusetts, Maine & Vermont, Superfitness is amongst the WORST two companies, as measured by the number of complaints. Nearly 21% of their BBB complaints go unresponded to.
I wish their were more effective ways for the small consumer to enforse accountability to fair and reasonable business practices, but it appears that business apathy, bad faith and neglect is working just fine for TeamSuperFitness. How sad.
