Initial Complaint:
Dexclusive shipped me a watch via UPS that I had to return because of a manufaturer recall. I purchased the watch through eBay via Paypal in the amount of $319.00 in December 2008. Dexclusive claims that they shipped the watch via UPS to me to a wrong address in July 2009 and has not yet refunded my money or sent me a replacement watch. Dexclusive claims that UPS has only reimbursed them $100 and they are awaiting the total amount, however, as of this time, I have been defrauded of $319.00. The original eBay transaction # is 330294027209. I would like a new watch shipped or refund.
Company's response:
Company states that with the shipping address it company policy to ship to the paypal billing address mr. cerra did not update that address until sept. 2009 company knows this because company verified the information before shipping. Company only ships to approved shipping address. Consumer then opened a dispute with paypal & dispute he lost. Company gave consumer benefit of the dought & opened a case with UPS twice & that case was closed twice because UPS stated consumer did in fact receive the merchandise.
Rebuttal Response:
1st Point: Dexclusive shipped package to Paypal address on 12/26/09. Watchwas defective defect and was returned to Dexclusive in 02/09. Dexclusive had not replaced watch by 07/09. I contacted them and requested a replacement or refund. Advised Dexclusive of a change of address prior to shipment. 2nd Point: UPS required a signature for the package. UPS investigators confirmed they lost the package No signature on file. UPS advised me that Dexclusive insured the package for $100. UPS refunded Dexclusive $100 claim & acknowledged package was lost. UPS advised that they only refund money if it is UPS’ liability. UPS can only provide written information regarding their investigation to the shipper. The above information can be corraborated by UPS. 3rd Point: Paypal case was closed not lost. It was closed because case was opened 45 days after original purchase. Watch was returned for replacement 45+ days after purchase. It is Dexclusive's responsibility to refund my money or replace the watch given the fact that UPS lost the watch. If Dexclusive only insured the $319.00 for $100 with UPS, that was the risk they took by insuring the package for less than what was paid.
*****Although UPS confirmed that package was indeed lost without a signature and refunded Dexclusive $100, the amount they insured the package for, I never received the full refund. Dexclusive refused to authorize me to get written documentation of UPS' findings to support my claim. This company has defrauded me and who knows how many other innocent consumers. Something has to be done about this.
