I signed up for a gym membership for one year in January of 2009. After a few months of going I had stopped because we had to move from our home due to forclosure and had twisted my ankle. I had checked my account a couple of months after not going and saw that Team Fitness were no longer deducting money from my account. I had assumed they had canceled me because I had not been in in a while. I never heard from them either phone or by mail until now from a debt collector saying I owed Team Fitness 650$. I thought there was some mistake and they read the contract to me that I had signed in Jan. of 2009 which entailed renewing my membership after a year automatically. So that meant I owed them for all of 2010 even though I had not set one foot in their gym for almost a year in a half. Otherwise, I had never been in at all of 2010. I was appalled. I looked back at my bank records and realized that sometime in 2009 my bank had sent me a new debit card because of a breach in my account. Which in result had led to negligent payments in 2009. I had called Team fitness several times to work this out hoping they would here my story and try and work with me on this matter. I told I would own up to what I owe for any missed payments in 2009 but did not seem fair to pay for a whole year (2010) that I never once used their gym. This is unexceptable and inhumane to do to a person wether they signed a contract or not. I was not notified by any of their members or employees about this. I did not have a copy of this contract nor was I offered one nor did I have it memsmerized after 6 months to a year. As part of any businesses, there should be some responsibility to the customer to give them some form of notification if something was wrong with any payments. After having my house forclosed I had a lot on my mind and in the mean time, this local gym was profitting off my shortcomings. They cleary told me over the phone they did not want to work this out or resolve it in any way nor would the owner speak with me at all. I hope this is the way to get justice and make it right and hope this does not happen to any one else. Please help me with this matter.
