We were customers of EMS for one year, gave them 45 days notice we were leaving for someone else, and were told we owed $300 for wrongful cancellation. The fine print buried in the contract gives one specific day of the year - "90 day" before the renewal that we can notify them we are leaving.

If you don't do it on that day, you can't even do a 90 day cancellation notice at any other time during the year, let alone a more reasonable 30-day notice. So if you miss that single day of the year that you can cancel, the contract automatically renews for a year and you have to wait until that one day of the year rolls around again the next year. Clearly a system set up to deceive their clients and make it nearly impossible to leave.

After three months of pushing back on them we finally got, in writing, that we would not have to pay the cancellation fee. They had already charged us a $60 monthly fee for the 60 days after we had given them notice, so they owe us $60. Since they continued to bill us after we had left them, we talked to our bank and had any future charges coming from them denied.

Last week we received a collection letter from them for $60 for the third month after we had left them but before they had agreed to not charge the $300 cancellation fee. So they clearly feel that charging me $180 after we left is not related to them admitting that we were allowed to leave the contract three months earlier.

The response from the local sales rep here in Denver, Greg Frick of Frick Holdings, was very telling. He said he had no control over it, couldn't do anything about it, and then went on to make himself out as a victim because we spent a good year with him and gave him 45 days notice and with a very nice parting note. That apparently was a slap in the face. I hate to see how he treats people who don't give 45 days notice or leave before the end of the first year.

I've left multiple emails and multiple phone calls for both Greg Frick here in Denver and for specific people at EMS and have received no response.

This is a sad commentary on a company that is willing to mortgage its future reputation to wrongfully try to get a few bucks from someone who was originally leaving them cordially. It's a company that doesn't understand the concept of good profit and bad profit. I would recommend that you not do business with this company or with Frick Holdings in Denver. They are apparently birds of a feather. Caveat emptor.
