I purchased a Jetski + Trailer from The Jet Shop at the end of Aug. After collection, I realised that the trailer was not the same one as in the ad or the one I viewed prior to purchase. It was also concerning, that the "wrong" trailer, went through a roadworthy, but the lights didn't even work.
I contacted the Jet Shop and after a few emails and phone calls, they said that it was a honest mistake and that they would source me another trailer as they never thought that it would be a problem. I'm still waiting.
Subsequent to me discovering that they gave me the wrong trailer without informing me, I also found out that instead of the jetski being a 2004 model as per the ad, it is actually a 2003 model. I'm also concerned about the fact that the make, model and dates on the seaworthy certificate that was issued to me, was changed/incorrect. This was escalated to SAMSA, but to date I haven't received any feedback. (I have record of all the emails, the original ad and the seaworthy certificate.)
I would like to know whether the Consumer Protection Act, allows me to cancel this transaction in its entirety. The trust relation has been broken and everything is different to what I paid for. If I do not have any rights to cancel, is opening a fraud case an option?
