We are pleased to offer you a position with TOTAL PETROLEUM PLC.
Fundamental rules and guiding tenets governing the modus operandi of the Company are as stated hereunder under EXHIBIT A column.
EXHIBIT A: SECTION 1.1
TERMS OF EMPLOYMENT ENROLLMENT WITH TOTAL COMPANY
1. Position and Duties. Total Company shall employ you and you agree to competently and professionally perform such duties, as is customarily the responsibility of the position as set forth.
2. Outside Business Activities. During your employment term with Total Company, you shall devote competent energies, interests, and abilities to the performance of your duties under this Agreement. During the tenure of this Agreement, you shall not, without Company’s prior written consent, render any services to others for compensation or engage or participate, actively or passively, in any other business activities that would interfere with the performance of your duties hereunder or compete with Company’s business.
b) Restraint of Trade
Total Company is not entitled to curtail the employment opportunities for employees merely because they have been employed in a field with them. However, it is reasonable for a well-paid employee to agree to a restraint of trade for at least the period of notice contained in this termination clause of the employment agreement. The wording defining the extent of the restraint in time and area needs to be carefully considered on a case-by-case basis.
3. Employment Classification. You shall be deemed as a contract Employee ab initio. Only employees who display remarkable competent energies during the period of their services shall be entitled to periodical promotions and/or consideration of renewal of their employment terms and status to a permanent duty assignment for the company in future advancement.
Compensation, benefits, and other terms of employment will be as set forth below on EXHIBIT B.
EXHIBIT B: SECTION 2.1
I. Insurance. You are entitled to Company’s standard employee package inclusive of health insurance, property and life insurance, disposal to medical facilities and human safety by the Health department and HSE sector in provision of prevention/avoidance of Industrial hazards. In the strictest sense, the above premise is fully abided to herein and hereafter.
II. Leave Period. Employees are entitled to a paid rotational leave period of 35 days/ 35 days on-off shifts. This paid leave rotation is however open to alteration in order to fit to the employees’ preferred or most suitable choice.
III. Accommodation. Employee must reside in the provided Total Company Residential Complex unless you independently arrange an alternative housing/hotel accommodation, which is absolutely devoid of Company responsibility. Total Residential Quarters is situated in a spacious terrain located at the outskirts of the metropolitan zone of the present capital of the country in Abuja, Nigeria. The accommodation has such functional basic amenities like treated pipe-borne water supply, constant electricity, internet connectivity, phone network connections, and furnished apartments to its credit.
IV. Relocation. Employee must be subject to Company’s vacation and relocation policy of rendering service to Company outlet in other African and mostly European Countries worldwide as such package and policy are in effect from time to time.
V. Pension Scheme Provision
Compulsorily, employees are enabled cum entitled to a pension pay package when fragile and out of service. On retirement and/or contract termination due to full completion of contract besides forceful ejection (perhaps due to wrong conduct), Employee Staff are duly offered this financial allowance as honorarium for your diligence and services.
Severability Clause. If any of the provisions of this Agreement are determined to be invalid, illegal, or unenforceable, such provisions shall be modified to the minimum extent necessary to make such provisions enforceable, and the remaining provisions shall continue in full force and effect to the extent that the economic benefits conferred upon the parties by this agreement remain substantially unimpaired.
