My name is Joseph. My friends and I have been renting out a unit in GoldReef Sands Complex (Unit 16) and my friends and I paid a deposit of R5600. However when we moved out, our deposit was never paid back to us by the owner as he believes that we paid our deposit to the agent by the name of Fatimah. His argument is that when the agent resigned or left, she did not hand over the deposit (all particulars) to him as the owner and as such the agent should have given us our desposit when she resigned. Now we don't know where the agent is as she never told us that she was no longer the agent of our flat unit. However we believe that the owner should give us our deposit as he ought to have known when the agent was resigning and we believe that he should have requested the agent to hand over all the particulars to him, including the deposit as he had the right as the owner of the flat unit. Our concern is that what do we do now as we have moved out already and our deposit has not been paid back yet. He was satisfied with the condition of the flat when we left which we don't believe that he's holding our money due to that. When we left he suggested we go the legal route of which one of our flat mate did by reporting to the Ombudsman however nothing has come out of it. Any advice or help!
