This is to inform all the Wal-mart and other none union companies and stores. This is happening right now as I wright. My mother worked back in the 80's for a comapany which name was back then Butcher Boy. Now it is known as Windsor Foods. This comapany manufactures frozen foods. That you can find in most of the grocerie stores like Food 4 less, Albertsons and many more. At the time my mother worked at this company she was promised that she had a pension plan which the local union was offering. Well she was let go in 1988. Now this company has changed owners like some one who changes under ware. So back in July of 2004 my mother called the local 439 (which was the one incharge in that time)to let them know that she was ready to apply for her pension benifit. So the union sends her the application she sends it back all filed out. And the only thing she gets back from the union was a letter stating "Since you did not reach the period of 10 years completed at Butcher boy. You have to wait till you reach the age of 60 in order to qualify for the pension benifit. Well this June 2009 she turned 60. So I called the union to let them know that she was ready to do her claim. By this time her local 439 was taken over by local 1167. And they tell me that the pension plan had been desolved and that the funds where returned to the company for a so called 401(k)plan. So I called the company and they tell me to call a certaine phone number so I did but they did not have any thing. This was a 401(k) company. So I called back the company and they start to give me the run around. Till I write a letter to the C. E.O. Then after the C. E.O. gets the letter I recive a call from the company. But I did not get any thing out of it. So I call the union back to see if I could get them to help me. But the only thing I got out of it was not a so good voice mail an my cell from one of the union reps. Saying that the socal pension/401(k) was desolved back in 2004 and at the time my mother had the chance to withdrawal the funds. But that it seemed that she had not applyed at all so the funds where given to Windsor foods for them to use at their likeing. So I contact the matrix of the union and I get a letter from the union Presedent telling me that some one would contact me very soon. It has been more than week and no one has called me to help me with my mothers pension. So you see unions in the end the only people that benifit are them. Cause ones they do not make any money from the employee. They turn there back to you. And they endup helping the company. Unions represent their selfs and that is it. I hope that some one can investigate this situacion. I know from other employes that still work at windsor foods that both the union and the company have riped off other people. With their pension benifits. My mother dose not speek English. But she is a natural born U.S. citizen. She only speeks Spanish. We have tryed to get legal help but have had no success. Please help us make the union and company respect the Employee Retirement Income Security Act. Wich this is a federal law. And they think that they are going to get away with it.
