taking money from bank without authorisation
i paid £3.99 shipping for a fee sample of these products about a month ago, since then they have taken two seperate amounts of £79 from my bank without my consent.

I did not request a second order of these two products Acai berry and life cleanse, only the free 14 day trial. You have taken £82.95 for acai berry and £82.95 for life cleanse total £165.90 . I request and demand an immediate refund to my bank account and you do NOT repeat do NOT take any unauthorised payments from my account ever again, or you will be reported to the proper authorities.

I too like lots of people have fallen for the viv 3 scam and was appalled to learn that even if I cancel my credit card and get a new one the old number will still be recognised.How can this happen in this day and age .Will be very interested to hear from anyone with help in regard to this matter.Also read that somebody had the pills tested and they are not what they say they are.Somebody out there must be able to help us .

I've got my refund
Hi everyone

Just to let you know that I received an email today and they are going to refund my money...its the usual standard letter sent to all those who get their money back (see below). Just have to wait for about 5 days now to see if it actually lands back in my account!

Then starts the campaign...exposure, exposure exposure!

Good luck to everyone trying to get their money back. Persistence is the word. DON'T GIVE UP!!!

Hope this can help anyone trying to get their money back
I really hope that the following information is useful in trying to get your money back, at least for anyone in the UK.

(1)BREACH OF CONTRACT

For those who cancelled their account within the 15 day 'free trial'...(check your receipt/invoice for exact shipping date)...and still got charged.

They have breached their own terms and conditions so it's worth writing to them and demanding your money back. If they don't respond pass it on to your bank or credit card company and get them to handle the dispute on yor behalf. (You'll need to show what efforts you've made to get a refund yourself, though)


(2)UNFAIR TERMS IN CONTRACTS

Anyone can use this. Either in conjunction with Breach of Contract or, where you didn't cancel in time, by itself...

"An unfair term in a contract covered by the Unfair Terms in Consumer Contract Regulations (UTCCRs) is not binding on you".

Test of fairness

A term is unfair if:


"Contrary to the requirement of good faith it causes a significant imbalance in the parties' rights and obligations under the contract, to the detriment of consumers".


'Good faith' means that traders must deal fairly and openly with you.

Although standard terms may be drafted to protect commercial needs, they must also take account of your interests and rights by going no further than is necessary to protect those legitimate commercial
interests.

Ayone who wants to get their money back could have a go. You should email them with your own info added.

Even if it doesn't work with viv3labs at least you can show this to yorr bank or cc company as proof of your efforts and then let them takeit over from there.

SCAM-DON'T GET FREE SAMPLES!!!
I ordered the free samples for trial, before I reciev the samples I was charged on my credit card a huge amount for the sample bottles. When I contacted the company I was told very rudely that my 14 days trial is over and I have to pay for the bottles. I told them that I haven't even recieved the samples and i didn't even have a chance to try to see if I want them. But they insisted that this is the policy and they don't deal with refunds, and they would not refer me to some one else that does deal with refunds. DON'T BUY ANYTHING FROM THESE PEOPLE. THEY ARE RIP OFFS!!!

same thing money out of account, i put in my details and loged off didnt submit, but 75.90 went out of my account. i had to cancelle my account and i got charged for going into my overdraft, how the hel are they getting away with this. So many complailts and nothing being done, what the hell do we have to do to stop these scams?
companies like viv3labs need to be stoped, there are people out there that need some help and they are still allowed to rip them off!! there must be some one out there that knows how to stop them??
The good ol usa taking the piss again!!!

viv3labs ad is back on hotmail
Hi everybody

Just to let you know that they're back on hotmail!!!

Has anyone found the infotmation on 'Unfair Terms in contracts' useful? See my previous message under 'Re Something must be done about this'.

I sent my email to viv3labs and still waiting for their reply. On their customer service website my 'ticket 'is still open so lets hope that they're 'shitting themselves a bit, now withiout the aid of tteir own Life Cleanse!
